Warranty Scheme and Failiure to Pay-out per Contract Agreement

On 10/21/10, contacted Mr. Colter per warranty contract requirements for vehicle running hot. Mr. Colter contacted Ala-Tune to come to and service our vehicle. The auto repair shop failed to do a complete diagnostic on my vehicle; subsequently, took our vehicle to another repair shop. Upon servicing the vehicle the repair shop found that there was not a thermostat in our vehicle and the computer system now read that the A/C unit was disengaged for engine protection. I immediately contacted Mr. Colter and informed him of the new developments. Mr. Colter informed me that he would reimburse me for the thermostat labor and the rental fee costs on 10/27/10. On 10/28/10 I contacted Mr. Colter. Mr. Colter returned my call and informed me that since my vehicle was not serviced at the "authorized" repair shop that he would not authorize reimbursement of my out of pockets expenses. I immediately asked Mr. Colter how yesterday he stated he would reimburse me for those expenses and that I would absorb the costs of the radiator however the thermostat, repair and the authorized repair shop failures should not be a costs I should be responsible for. Mr. Colter then stated that I didn't have a leg to stand on and how he didn't know I did not take the thermostat out of the vehicle. I informed Mr. Colter that had the authorized shop he selected performed the necessary diagnostic then the vehicle would not have had to be serviced by a different shop. Mr. Colter did not deny that fact but stated that since he did not authorize repair (even though I contacted him on 10/27/10 that the vehicle was at another shop and that the thermostat needed to be repaired) that he would not reimburse my out of pocket expenses. The costs were $130 for payment to Ala-Tune for the incomplete diagnostics and towing expenses, $27.00 for the thermostat, $150 for car rental and $150 for labor totaling $437.00.

On Friday, 10/29/10 Mr. Colter contacted me and asked me "Are you ready to be reasonable this morning" Stating that he could not authorize payment for the rental car "However, he was willing to pay for it 3 days prior and the warranty company specifically stated that it was at Mr. Colter's discretion as to what he would and/or could authorize and that they could not override his decision".. Mr. Colter has failed to honor the contract of the warranty specifically authorizing reimbursement or payment of expenses for repairing said vehicle. The costs were $130 for payment to Ala-Tune for the incomplete diagnostic and towing expenses, $27.00 for the thermostat, $150 for car rental and $150 for labor totaling $437.00.
