In October of my roommate borrowed my car to go pick up his daughter from band practice at her high school. A guy in front of him in an older Toyota 4 Runner slammed on his brakes suddenly. There was no need for the guy to slam on his brakes. My roommate slammed on the brakes and did not hit him. Then the guy in the 4 Runner pulled forward, put his truck in reverse and then slammed on the gas. He purposely backed into my car. Both got out of their vehicles, and when my roommate told the guy he was calling the police, the driver who hit my car took off.
Luckily, there was a truck behind my car and that driver was already on the phone with 911. Also, there was a couple in another vehicle who saw the incident. They stayed and filled out a police report. All witnesses said they had a perfect view of what happened and indicated that my roommate was not tailgating and that this incident was absolutely road rage.
When a police officer arrived, he was given the plates of the driver who hit my car and took off. The officer then went to his house to talk to him. The officer found the truck with damage to its back fender. When the officer tried to talk to the guy, he smelled of alcohol, cussed at the officer and wouldn't talk to him. So, it's obvious this guy was drunk while the accident took place but could not prove it. There is more to the story, but the situation is that my car was hit on purpose for no reason.
Luckily, the driver of the 4 Runner had insurance. I contacted The General and filed a claim. After a few conversations, The General stated they would pay for the claim and would continue to pay for a car rental, also. They said they sent out a check. I never received it. After being told to wait about 10 days, they reissued another check after I called them several times. On all the calls, I would ask if they received the first check returned to them. They said they never received it back. Then, I did not receive the second check. Once again, plenty of calls, I needed to wait and no, they never received the second check back either. After getting a hold of the adjuster (who would never answer my calls or return my calls. The General customer service-that's a whole other complaint) he told me that he couldn't send out another check. After asking where the checks were because they weren't with me or with them, he couldn't answer. I finally got him to agree to send it with delivery confirmation. I received the check 2 days later.By the way, the damage was $2800-just from this guy 'backing' into my car. That's a pretty hard hit!
The General stopped paying for my car rental before I even RECEIVED the check. Not only should they be paying until I receive payment, but they should allow for a few extra days for my car to get fixed. I have not been able to fix my car, just touch it up a little bit so that it is now legal. There should be no reason why they stopped paying for the car rental. After all, they paid for the damages so that must mean they are admitting their insured was at fault. I am out $457 for an incident (not an accident) that I did not cause. The General told me that they are not responsible for the mail system. I told them I am not responsible for the mail system either and I should not be out any money for the incident that happened. They are the ones who insured a guy who has temper tantrums like a little baby.
