Ripoff Deceptive Practice, Company is LIABLE for making false statements to their customers

Below is a letter telling my dealings with Mitsubishi Motors Credit Of America (JAPAN) to the VP of their finance division.

Sir,
I am writing in regards to a recent document I received from your Special Collections Unit. It states that I am in dept to your Company for a total amount of $3,497.50. After reviewing the document it appears to me that the whole account is being treated as a repossessed vehicle. I was aware that I was behind 3 installments at $367.85 for each payment for a total of $1103.55.

Prior to the end of my contract 05/08/03, as stated in a letter from your company dated 09/11/02, I spoke with a person identifying herself as Rachel in your Vehicle Recovery unit. I spoke with her about the past due payments and tried to make arrangements with her to set up a payment schedule that would satisfy your company and myself.

Rachel said she was unable to make the arrangement, as that was not her department however Rachel said that the vehicle was in danger of being repossessed. She stated however, if you deliver the vehicle to a mitsubishi dealership the vehicle wold not be considered a repossession, it will only be considered a repo if taken by the towing company contracted with. Rachel gave me instructions that upon arrival at the dealership to contact her.

On 05/08/03 I arrived at SPORT MITSUBISHI in Orlando Florida and was advised by the manager of the dealership that the Lease turn-in person was not working that day. I contacted Rachel at the number provided, 1-800-770-5983 ext 12555. I reached Rachels voice mail and left two messages.

After about 90 minutes I returned to my home where I received a call from Rachel later that evening. I told her that the Lease Turn-in person was unavailable. Rachel said that was not a problem just take it to the same dealer the next day and call Veronica and advise her of the vehicles delivery at the dealership. I went to Sport Mitsubishi on 05/09/03 turning the vehicle in and received copy of Odometer Disclosure statement. If the comments by Rachel are not true and correct as stated to me I feel that her TACTICS were very deceptive in nature and feel your company is LIABLE for making false statements to your customers.

Returning to the statement I received I feel that is not my CONTRACTUAL OBLIGATION to pay for the losses incurred on the vehicles auction price. I feel the vehicle would have brought more money had the vehicle not had inferior paint on the vehicle. I can provide, or you can research, that the vehicle had to be repainted on two occasions due to cracked paint. The entire roof and the rear deck and both rear quarter panels had to be done. This service was provided via Holler Mitsubishi/CAR ER in Winter Park Florida, The original Dealer vehicle Purchased/Leased from. The Lease Turn in associate at Sport Mitsubishi also gave the inferior paint remark to me. MITSUBISHIS BLACK PAINT HAS ALWAYS BEEN INFERIOR IN QUALITY AND DURABLITY Is what he quoted to me.

This I believe this adds more weight towards your company absorbing the loss at auction on the vehicle. I would also concur with his statement having been a salesman selling Mitsubishis for a 3-year period in Illinois. However I strongly believe in the product and would not be discouraged in owning another in the future. However I will actively discourage friends and family from doing any business with your finance company. I currently work for Walt Disney World Company and have access to 50,000 possible customers in just the Orlando Market via email and would not hesitate to forward my displeasure with your companies deceptive and misleading actions.

I would greatly appreciate your looking into the deceptive tactics made by your company. I have every intention and good faith in setting up a payment schedule for the past due payments I owe. I do feel however that I will not make any payments until that agreement has been made and that I am not liable for the losses incurred by your company on the vehicle at auction.
