Researching Legal Assistance for Class Action Suit

I started having problems with CPS when I was hospitalized and I could not catch up with not only my car note, but all of my bills. CPS started calling my place of employment and my family members (who were not too happy to receive these calls). Finally, I was able to get through and talk to someone at CPS. I explained the situation to them. They were very, very picky as how this payment was to be made and attempted to make it very inconvenient for me to make said payment. They did not want me to make a payment utilizing their website (which is a $10 fee) nor did they want me to make a payment utilizing my checking account online. I feel that this is discriminatory since money is money. They wanted me to go to Wal Mart and make a MoneyGram payment to them. My question & if you only have enough money to pay the bill, how would you have enough money to pay an additional fee for a MoneyGram? Like I said, I was hospitalized so I was not about to venture out of the house and go to Wal Mart because CPS wanted their money.instead, I made the payment via their website and before the payment due date. Well, two weeks later, I was reviewing my checking account only to find out that CPS deducted another payment which I did not authorize in any way, shape or form. Of course, this caused all of my other transactions (i.E., bounced checks) to go into overdraft. I stopped it immediately and I was forced to close the account and obtain a new one. Now, I am getting voice mail messages stating that I did not keep up with their agreement and they are forced to file a claim with the State's Attorney's Office. Please note that I am upside down on the car note. The car is worth $4,000 and I owe $7,000.

This is only part of what has occurred with CPS. I could go on and on. Upon reviewing complaint, I found that I was not the only person going through this madness. Now, I want to take action. So, I filed a claim with the State of California, Department of Consumer Affairs and I received this recent e-mail:

"Thank you for contacting the State of California, Department of Consumer Affairs (DCA). The information you provided indicates that this is an issue that falls outside of the DCA's regulatory authority; however, we would like to offer alternative options and information for possible resolution to your complaint.

We recommend that you consult with a private attorney to find out more about your rights under these circumstances, since the issues raised are of a legal and/or contractual nature. You may locate an attorney via the State Bar of California, Lawyer Referral Services Program Web site at http://www.calbar.ca. Gov/state/calbar/calbar_generic. Jsp? Cid=10182&id=1403

If you cannot afford an attorney, you may wish to contact a local Legal Aid Society for possible assistance. Legal aid societies provide free legal advice, representation, and other legal services. You can find a legal aid society in your telephone book or via the DCA's Web site at http://www.dca.ca. Gov/publications/guide/legal_index. Shtml."

I also have filed a claim with the Federal Trade Commission. I am filing claims all over the place until my voice is heard. I am also researching Class Action attorneys within my state of residence in the hopes of retaining one who does not get paid until the case is settled. I am not sure if I should retain an attorney who is within my state of residence or should I go through California (where CPS is located).

Once I have found this Class Action attorney, I will post his/her information here so that all of you can contact him/her. Remember, there is strength in numbers. Let's fight this one. We cannot lose!

Regards
