I almost died and was treated like nothing my driveshaft fell off on freeway

In January I visited EXPRESS TIRES in the city of Temecula, CA. My visit to their company was due to the low tire pressure I had on my 2000 Chevy Tahoe. After a diagnostic check, Express Tire advised me that a number of other mechanical problems had been identified. I agreed to pay $391 in order for them to complete the service they advised me was necessary for my truck. Once I left the Tire shop, approxamatly 5 minutes later, My truck lifted off the ground and came to a sudden grinding hault.

I contacted AAA at my own expense, and was advised that my drive shaft had fallen out. I used my last free tow from my AAA membership to have my truck towed back to Express Tires. Express Tires informed me that they took complete responsability for this, apologized and explained they would fix my truck. They stated they fixed my brakes due to the problems they had caused. Once I picked my car up the second time, I began my trip back home..

Again, I experienced the same mishap, as my drive shaft fell out once again, and once again nearly caused me great bodily harm. Again I contacted AAA and had my truck towed back to Express Tires. This time AAA informed me that the last time I towed my truck, was my last free tow, therefore I would be charged for the milage. I received a bill in the amount of $135 that Express Tires informed me they would take care of. After the second time fixing my truck, and picking it up, I felt that the less I drive my truck with my two young children, would probably be the best decision.

Unfortuantly, one day after picking them up, on our way home, the same thing happened, causing exteme fear in my children. I then decided not to have the same shop that had previously serviced my truck twice before, service it any more. I contacted the customer service department to find out what other options they were going to provide me, and what was going to be done. I came into contact with a representative by the name of Brian. Brian asked me to have my truck towed to a AAA sponcered mechanic to have it evaluated. I explained to Brian that I still had no towes left and was informed that I needed to just have it towed, that they would handle the expense. Once they received the truck and completed their evaluation, they informed me that the problems were in fact caused by negligence at Express Tires. I contacted Brian back and asked how should we proceed. He then informed me he did not trust this shop, he wanted my truck to be evaluated by one of their chosen companies.in order for Certified Auto to release my truck, I had to pay out of pocket an additional $101.25. Now my truck was towed to American Eagle Transmissions. Gary from American Eagle informed me once he performed his evaluation, he too came to the same conclusion. Not only was Express Tires at fault, but that I was extremly lucky no harm had come to me or another member of my family. He stated he faxed over to Brian at Express Tires this information, and informed them that they were at fault. Once I received this information, I contacted Brian back and asked what was the next step to completing the repairs necessary to fix my truck.

At this point, I did not advise Brian that I had already spoken to Gary from American Eagle and was aware they too claimed Express Tires at fault. Brian asked me to come up with a figure I felt would compensate for the situation at hand. He stated he would like to just settle my claim. I then asked Brian if he received any faxes from Gary and he informed me nothing had been received yet. I then decided to contact Gary once more to verify I was not mistaken. Gary informed me, not only did he fax over the necessary documention, but he had also held a conversation with Brian. I decided to call Brian back and find out what was going on. At this time, Brian stated that Gary said the fault lied not only on their part, but mine as well. When I asked Brian if he was sure this was in fact so, he stated he knew we had been threw a lot, so in order to help me out, he would either purchase a used transmission that already had 100 thousand miles on it, or I could settle for $600 yet the damage is a total of 3500 dollars stated by his approved shop. I explained that was unacceptable and requested that they service my truck as previously disclosed, and also asked that I be reimburrsed for all the extra money I have already put forth. Brian then stated that Gary mentioned to him that Express Tires was not at fault, so he was going to deny servicing my vehicle all together. I contacted Gary back once more and was informed that Brian was lied to me. Gary has offered to fax over the exact documentation he sent to Brian and also provide a deposition in regards to the exact situation and the way Brian from Express Tires is trying to manipulate the situation. Now, not only am I out all of the extra money I had to come out of pocket for, but my truck is still sitting in this shop damaged. His own mechanic said take them to court. Truck not working money lost and possible back pains but never went to a doctor to evaluate me so i figured no immediate attention loses relevance.
