The 325i BMW was advertised to be one owner, 7k original miles, nonsmoker in mint condition with existing warranty. Since he had a car fax to back up his information I purchased a Auto CHeck and got the same info with their buyback guarantee (carfax and Autocheck will find only published info and the warranty does not cover nonpublished info). The seller Nick Roshanara, failed to mention the car had been totaled by Progressive Ins.in Grand Prairie, TX on 12/22 with approx. 88% damage to the car. TX had a law that if 75% or more damage was done they would have to brand the title and if more than 95% damage was done the car would have to be used as salvage (transp. Code 501.0911 through 501.0931 but can't find a Lawyer that wants to fight Progressive and there are outstanding judgements against the Seller which makes going after him a waste of money. When we took the car in to BMW for service we found the car had been totaled and we had NO WARRANTY! Nick said it was not his problem.
Lesson Learned:
1. Put no creditability in published or verbal description or advertising
2. Put no creditability in Carfax or Autocheck
3. Until you know different assume all states & insurance Co.'s protect the fraudulent car dealer or salesman
4. Call a car dealer of the car make and have him run the Vin # to make sure you have warranty
