Foreman Motors, Inc
Nondisclosure and fraudulant used auto sale

On 1/29, my son called Foreman Motors in response to an ad he had seen in an auto magazine. It stated that all of their autos came with a warranty, unfortunately the time on the warranty differs with everyone you talk to and they have never given us our paperwork. When my son first looked at the car they said they needed $500 down, after giving them the $500 check and them putting it through as an electronic check. After speaking with the woman on the phone at the supposed funding source who told us that we were approved and that the payment would be $120 every two weeks we were told to wait until the papers were faxed over. After waiting at least another hour, we were told that they needed another $500 down. They said we could give them another check and they would not put it through until the following week. My son asked if he could use his Camaro for a trade and they said yes, another hour or so passed and they said they needed both a $1000 and the car. We left there that night with the agreement that they would pick up the car the next day as my son was working. My son thought about it and asked me to call them in the morning and tell them the original $500 and the car or no deal. They agreed to this, sent someone to pick up the Camaro, and offered to bring the 2000 Tiburon he was purchasing to his job as he was working late. At that time, they were to return the second check. They brought the car to his job and did not have the second check. I refused to sign anything until he at least signed something saying the check would be returned. After Adam, the salesperson, called the office and after he had a lengthy conversation with the office out of our hearing range, he finally signed a paper saying that the check would not be cashed and that the total down payment was $500 plus the Camaro. We then signed the papers to complete the deal on the bumper of my car. I asked for a copy of the papers and was told he did not have a copy and that they would be sent to us. I have called a couple of times and still have not received any paperwork. The only thing I did receive was a letter in the mail dated 1/30 stating that the first regular payment of $118.65 is due on 03/01 and that a "pickup payment of $360.00" was due on 2/15. No one had ever told us anything about any pick up payment. When I called the 800 number I was given to make my payment to they had no record of us. When I called Foreman I was now told that they were financing the car directly and needed to pay them. Was the $360 a way to recoup part of the $500 they had to refund us? A couple of days after purchasing the car my son took it for routine maintenance, as he had no idea when it was done. They could only change the oil and wiper blades. They told him the brake shoes were rusted and that the lug nuts were so rusted that they could not take the tires off until he brought them new lug nuts. Blake left with the car and was to bring it back the following week when he got the lug nuts. On Wed. 2/13 Blake was out in his car in the rain. He went through a puddle and the car promptly died. Thinking it had stalled he tried to restart it without success. The car was towed to Tires Plus on Merritt Island, FL the next day and called us telling us that water had gotten in the engine, seized the engine, and broke the starter off. They further told us that the engine was a junkyard engine not the original equipment, another fact that was not disclosed to us. When I called Joe the owner of Foreman I was told that, it was not his problem because the car had driven for 2 weeks. When I asked why it was not disclosed to us that it appeared that the car had been in water and that it was not the original engine he replied, "How would I know that". I said automobiles are your business and you are going to tell me you did not know anything about this. He told me the warranty was only good for 24 hours and basically, it was not his problem. When a friend of ours called Foreman acting as if he wanted to purchase a car he was told that "all the cars have a warranty", one salesman said the warranty was good for "24 hours or a year" and another one when he called back said that Foreman would cover 1/2 the cost of parts and labor on the Drive train and engine. They also told him, when asked if they inspected their cars before selling them, that they do an "inspection on all" of the vehicles that they get there before they are put up for sale and after they are sold before they leave their lot. How did they inspect the brakes on this car if the lug nuts could not be removed? And how did they miss that it had junkyard parts on it? I called Foreman again on 2/26 and asked to speak with the owner. I was told they were too busy to talk. I asked for a manager and they put Joe (I'm not sure but I think it was the same Joe who was the owner) on the phone, I told him who I was and that I thought I had talked to him last week and he said, "oh, it must have been Danny". He put me back on hold and Nadia came back on and told me they were all too busy too talk to me.
