We purchased a new (older model, manual transmission) Kia Spectra from Banner Kia. While waiting to sign the closing papers (we have copies of all closing documents, signed by both parties), we visited the service area, and was told that if we ever change our own oil (which I sometimes do), that this could void the new car warranty!
When doing the final task, the next morning (delivering the check for the signed deal), I expressed my displeasure with what I was told, as far as servicing this vehicle. Later that day, the sales manager called me, without warning, and said they "cancelled the sale".
After thinking about it, we (on our end, anyway) had never decided that we wanted out of the deal, and we had the signed deal that had already been done, that we wanted to honor. So, I went back, to get the car, but the sales manager told me the "window of opportunity" for me had passed!
Is a signed contract, by both parties, a "window of opportunity"? Lets say I wanted out of a signed contract, would they let me out, because I didn't want the "opportunity" any more?
I do learn things most days. Am I missing something, here? Is this type of stuff allowed, and legal? For most of the sale, I really was a big fan of this dealership - from what we found out, before we went there, they had a good reputation in our community, and this abrupt change of behavior really shocked our family!
So, we have all of these signed agreements, and they have a check of ours (that was not cashed) - we feel they need to deliver the car we signed for, and apologize for all of this delay at the end, or give us a real explanation of how they can cancel-off everyone's signatures.
