Consumer car fraud and extremely horrible business practices

I am extremely hurt, frustrated, and soon to be financially devastated due to a recent vehicle purchase. I certainly feel I was wronged and will not stand for M & D Auto Sales consumer sales practices. I am a single father of 2 and can not believe my incredible story of CONSUMER CAR FRAUD and 1 auto lots incredibly bad business practices.

To top all of this I have recently learned all others have been fired from M & D Auto Sales due to lack of better business practices!

I purchased my vehicle in April while Tony (Manger) and David Haynes (Sales) ran M & D Auto Sales in Lakeland Florida. On the 2nd day of my vehicle purchase it began to act up it major ways and I had gone back to tell them I no longer wanted the vehicle, that I was feeling very uncomfortable but was assured and promised by M & D Auto all requests would be taken care of and that they would have everything fixed as asked. I was advised I would have to have it fixed with one of their auto shops and to schedule it with Duane at Gerald's Automotive.

After 2 other attempts at Gerald's Automotive I had began to feel extremely uncomfortable and had Orlando Jeep Chrysler Dealership do a full inspection on the vehicle and was completely dumb founded at what clearly visible expensive repairs needed to be done. I faxed the inspection report to Tony and David at M & D Auto Sales and again assured and promised all requests would be taken care of and that they would have everything fixed as asked. They told me that large dealerships make up a lot but would repair everything on the list. I didn't want to get to loud because I was brought to them as a referral from a friend and was also assured that they would make good and have everything fixed. He had even allowed me use one of his cars as a rental for 2 weeks from his lot at Main Street Motors while my vehicle went in for repairs.

Simply I have made over 8 attempts to have items that were promised and the others that were still under warranty properly repaired. I had also stopped out 2 other times; I have been out of my vehicle for 2 weeks and have missed a lot of work in the interim to have it supposedly repaired as promised. I have also since learned I have been lied to about all repairs straight from the auto repair shop that the repairs were never fixed at all and that my vehicle was never inspected at all. I was also advised they just take vehicles from auctions and put it on the lot without any inspections.

On July 17th, I called (863) 665-3765 to speak with Duane at Gerald's Automotive to follow up with the repair documents because my car had still been acting up and I knew there wasn't something right but did not have the money to take it back to the dealership for additional inspections. I was advised from the mechanic that he felt for me, that he understood because he was told by Tony and David at M & D to make stuff up every time I called and basically none of the repairs that were promised were ever fixed. He basically told me that the only thing they replaced was the oil pan and they had nothing documenting any repairs but that. He had also told me that M & D had gone through some internal firings and had advised me everyone at M & D Auto Sales because of corporate getting to many complaints. He said they found out they had scammed a lot of people and a lot of money. Told me to call and said there was a new manager in the office named Jessica.

I called M & D Auto sales that same day and spoke with Jessica. She had me explain my situation and told me all others have been fired from M & D Auto Sales due to lack of better business practices. She asked that I fax everything to her on all the documents I had and that she would have to get a hold of Corporate and speak with D. Smylie who was her point of contact at Mathes Management in Orlando (Corporate Phone: 407-826-5829). I had attempted to fax Jessica several times without success and she had advised me to fax it all directly to corporate and that someone would contact me back (Corporate Fax: 407-859-0103).

I had called M & D back and spoke with Jessica and she told me she had no clue what was going on and that they had no documents of any repairs and scheduled repairs that were done and that I would need to follow up with D. Smylie corporate contact at Mathes Management in Orlando Corporate Phone: 407-826-5829.

On July 19th I had spoke with D. Smylie. She had advised me the only thing she would do is have the vehicle re-inspected by one of their mechanics and have only what repairs would meet the warranty agreement. I explained to her that was unacceptable and that everything is documented, dated, and crystal clear. I knew she was going to give me the run around, so she told me to call Mathes Management Corporate attorney by the name of Mike Mathes (Phone: 407-240-2345 and Fax: 407-859-0103).

I can't explain enough how extremely hurt, frustrated, and how they have financially devastated me. I can't believe nor will I lie down to these types of business practices and will actively file complaints with the Better Business Bureau, States Attorney Offices, Investigative News Offices, DMV Complaint Affidavit, and now seeking additional legal advice to peruse and sue for consumer fraud. These people at M & D Auto Sales and Mathes Management do not or should not be running any business's and need to compensate everyone M & D Auto Sales lied and stole from. Stop them now!
