I purchased a used transmission from Harbor Auto Sales in January with a 90 day warranty. It was immediately found to be defective. After accusing the mechanic (Lee Myles) of sabotaging the transmission (and after admitting they do not perform a road test of transmissions before they send them out) and after some reluctance, they sent another one.
The 2nd transmission they sent was not the proper one for my car-it wouldn't fit. This was now in early February. They said they were too aggravated with the situation and would not honor the warranty. They said they provide me a refund but only after they received the defective transmisisons back from the mechanic. They said they would make the shipping arrangments. I notified them of the availablity of the transmssions (that they were on a pallet) in early February.
It is now the beginning of March and Harbor has not made arrangements for picking up the transmisisons from the mechanic's shop and will still not refund my money, sticking by their position that they will not do so until they have recieved the transmissions back in their whop (obviously to sell the defrective transm=ission to some other unsuspecting consumer). I call them regularly and I am given the run around, with my call often going to voicemail when they learn who I am.
I have dealt with Jim the salesperson who is very beligerent, particularly in light of the fact that he has no qualms telling me that he is breaching the warranty. His supervisor Bill, went so far as to admit that he is "yessing" me whnever I call and speak with him about getting the transmisisons picked up and my purchase price refunded.
Bottom line is that they breached their warranty and the warranty of merchantability, and have refused to refund my purchase price.
