Lied about warranty, shipping, time frames, makes excuses, very dishonest

On November 11th, I purchased a motor from ASAP motors in Houston Tx. W / an extended warranty. The company did over over the phone check with me and shipped the motor promply when the check cleared. Once the motor was installed by my mechanic he and I both noticed the motor had an internal chatter. I contacted ASAP motors immediately to inform them. I wasn't able to talk to a manager right away so i told my story to anyone who answered the phone. Since the motor automaticly comes with a 3 month i saw no problem with them fixing the problem.

I was told to sign and return a Return Authorization Form and they would send someone out promtly to pickup the motor once my mechanic removed it. It took 11 days to finally get the proper forms to sign and return as they kept sending me copies of the warranty info and not the proper forms. Once someone finally did come pick up the motor nearly 2 weeks had gone by. At the time i called ASAP motors to find out the status of my claim. I called for 3 weeks and no one could tell me anything, All i kept hearing is " someones on it right now and we'll have an answer for you tomorrow."

Finally i was able to talk to manager which i had been requesting since the beginnning of the motor trouble. Elvin Jones told me quote" Since that motor has been returned aint nobody even looked at it." Remember now this has been 3 weeks since i had returned the motor. He told me he would get someone on it right away and i told him that's all i had been hearing since dealing w / them. He promised and said he would call as soon as he found something out. Another week went by and i had to call again. He informed me that the heat tabs had been melted which means I over heated the motor and was the one who damaged it. I told my story again as to how as soon as the motor was installed it made noises well before it ever reached operating temperature. As a matter of fact the motor never reached operating temperature during the time i had the motor. It only chattered when you reached 2500 rpm or higher. So to be cautious i shifted gears while driving the truck earlier than normal to prevent the chattering. The motor had to be damaged before the ever shipped it to me. It couldn't have been tested because they would have heard the chattering as soon as they started it up and revved it. Every time i started the motor it chattered and then quieted down.

Elvin informed me that my warranty was now voided, because their policy states that melted heat tabs void the warranty. So i was upset but stiil tried to get ASAP motors to help me. I asked if they would give me the same motor back but just use the money i paid for the extended warranty to fix it. He told me "NO." I asked even though i was only able to use the motor for less than 2 weeks, and the fact that it never was a properly running motor. Still he said"NO". So I asked well will you at least return the motor to me for free. I did pay $199 extra dollars for an extended warranty. He told me any repairs or shipping i would have to pay for my self. Since all the warranties are voided. And that ASAP gets to keep all monies spent with them. I asked to speak to someone higher than him who might be able to help me. He referred me to Dina who makes all the final decisions. I expalined the whole story to her in great detail and she also refuse to help.

I explained to her that i was offering to keep their defective motor even though i didn't damage it, all she would have to do is pay $85 for shipping. She too told me "NO". She added that i have 10 days to decide what i want to happen; she would either ship the motor back to me at my expense or she would throw it away. I opted to have the motor shipped back to me and just have my mechanic fix the chattering. But i began to realize that i had been duped. They sold me a bad motor and a warranty i cant use and they wont even help me out. I informed her that i want the motor back and i will be seeking satisfaction further through legal actions. At that point she got slightly rude and transferred the call back to Elvin Jones and he said he would get the paper work in order to have the motor shipped back to me. THat last phone call was the first week in January and it is now February 16. I have been trying since November 28th to get this resolved. I still have not received my motor back from them and i live only 3 hours away from this company. I sent them a demand letter from my Law firm of Ross & Matthews stating what i would be seeking in monetary satisfaction on January 20th. No one has called and Elvin was the one who sign for the Certified Letter. I have spoke to Elvin 3 times since the letter was sent and he hasnt mentioned it once. I have called nearly every Monday and Friday since January 11th to check on the status of them shipping my motor back to me.

I keep hearing the same thing. "it's being prepped to be shipped, it'll be out either today or tomorrow. If not give us a call back." To me the people that answer the phone down there At ASAP have a script to go by to keep disgruntled consumers on standby. They have never called me at all. Everytime i call i have to remind them of who i am and what my problem is. I am on a first name basis and recognize certain employees voices ie. Bruce Coleman and Elvin Jones. I have no desire to speak to Dina (head manager) as she was rude and unkind.
