Won't Listen, Unhelpful, Rude highway robbers Ripoff

I was amazed to find this site and was relieved to find that I was not alone in my frustration with this company.in 2002 my husband and I had purchased our 1998 van. I wasnt excited about purchasing this van i felt it was overpriced. We didnt have the best credit so we had to go with a company such as Americredit. Because my husbands credit was soooo bad they wouldn't even allow his name on the loan. I did not want the car but I signed the papers against my better judgment and i have been regretting this ever since.

Shortly after purchasing the van he left me and 4 children along with the nice big car payment. We had to go bankrupt. I had a really good job but while I had to pay for the bankruptcy and the divorce a house payment and a car payment that was 400 a month i was going through some rough financial times. Although we went bankrupt I kept my house and reaffirmed on the car. I was able to keep up on the car payments for a couple of years, I was late a few times but I would always call and let them know when I would pay. Even when I called they would still continue to call and hound me. This past summer of 2005 I lost my job due to budget cuts. I immediately called them to let them know the situation. I was getting some unemployment but it wasnt much, I was having difficulty paying these high payments. I started to be late on my payments and i would call them to let them know but it got to the point to where it didnt matter whether I called or not they would still bother me and they were sooo rude. I explained to them my situation, I wasnt expecting them to feel sorry for me I realize they need their money. I have had every intention of paying this debt I kept this debt even after going bankrupt when i could have let the car go and they would have lost out. I explained to them that i lost my job and i was doing the best that i could and they said to me well thats not our problem you need to make your car payment. I so badly wanted to say No s*t sherlock, but you cant get blood from a turnip. I am a very easy going person but once someone p*es me off to the point of no return look out. I guess it would have been nice if they would have tried to work with me and possibly looked into my history with them. One day I called them and asked them for a deferrment, that day the lady said that i would be able to do that. I had to wait til the end of the week. When i called back to do the deferrment they said i am sorry we no longer offer those to our customers. I explained to them that the lady the other day said i could set it up they just siad sorry we need the full payment. I was unable to pay the full amount that day but a day or two later they called me again wanting payment. I explained the situation to them again that i was unemployed and having difficulty, I hate repeating myself to them all the time i wish they would make notes in the computer. A week later i called back to make a payment adn i thought i would ask about a deferment again to see what they might say this time. The lady said well we had a deferrment set up for you but you failed to call back and make the payment so we can no longer offer that to you. She said I need the full amount today or you will have to surrender your vehicle. I was afraid to say much for fear i might cuss the woman out. I said well i guess you will have to come and get it, I called you wanting to make a payment of some sort today and you wont take it so i guess you will have to do what you have to do. I was at my mothers house that day when i made the call, 2 minutes later the phone rings adn its americredit and they asked for me. I asked them how they got the phone number she said we have caller ID. I said well after this please dont call here this is my mothers house. The lady offered me the defferment on the vehicle i said i just spoke to someone a few minutes ago that argued with me and wouldnt let me pay the deferrment. She siad yes i know she just gave me the papers and told me to give you a call back.in my opinion that was uncalled for the lady before just felt like arguing adn trying to push her so-called weight around and bully me.

Sorry for rambling on but here is my dilemma at this point I now cannot afford this car. After paying on this car for a few years I still owe 10,000 and the book value on the car is approximately 6,000. I went to my bank they told me they would pay americredit book value for the car and send a check immediately if they would agree to this. I cannot get ahold of anyone that could possibly help me. I called americredit to ask them if I could speak to someone that could help me work out a deal and she said you can talk to me adn i can tell you that we dont do that sort of thing. I explained to her that i cannot afford these payments that my employment situation has changed, at the time i purchased the car I had a very good paying job and right now that is not the case. She didnt care she kept telling me your only choices are to pay the payments or surrender the car. I am doing the best i can on these payments but I am always a bit behind and soon i am sure they will be knocking on my door but i am screwed because if i surrender the car I am not any better off I would still be responsible for paying for the car I dont have. I am sure they dont want to call me every day begging for money and I dotn like the fact that i cannot make the payment that i committed to but life situations change sometimes they are beyond our control. I am trying to make a deal and take care of this but they would rather be stupid and stubborn. What can I do and does anyone know if there is anyway to contact a president or someone in charge at americredit or am i just screwed?
