Deceptive Trade or Breach of Contract or Scam, You Choose Ripoff

I had gone to Joe Myers Kia off of 290 approx. On July 16 or 23rd & looked at a vehicle. The sales person that is not there anymore said he would not be able to help me due to my credit history. So I said fine - I had no problem with that. On July 29th a different sales person, called and said that his manager, wanted me to come in because they could assist me.

I told him the situation I had with the last sales person & I did not want to make a wasted treat out there. So I told him to pull my credit & once his manager reviewed it and said definitely they could - then I would. He called back and said yes. I put $700.00 down (check cleared on 8/8/05) and traded my vehicle (which was upside down - balance of approx. $9,600 left) and left with a Kia Sportage that I wanted.

They then called me on 8/10/05 (a week later) and the sales person says that there has been a mix up with the fiance company and I would have to either put $2000 down to keep the sportage or get into a sorento which was more money but it had a $2000 rebate. This is after I had gone in there previously and signed the final sales contract and purchase agreement.

I left work and went to the dealership and talked to the general manager. I explained the situation, I already changed vehicles on my insurance - which my insurance company has charged me $91 for changing my policy. Now I have to call again to change it back - another fee. I explained that I did not want a Sorento, its was larger and I didn't want to be forced into something that I was not comfortable driving or want. The Sportage was cheaper than the Sorento

They had me look at a Mazada Tribute, which was more money and would cause me to have a higher payment. I asked for my old car back and my deposit. I received my old car, but they are telling me to come back tomorrow and make another trip (Total of 6 in all) to get my deposit but I have to prove it cleared my bank - which I faxed and have not received a call back. I felt so deceived, disappointed & emotionally fatigued. I had something I wanted taken from me - I feel they breached a contract. We will see if I get my deposit back. Now I wonder why they let the last sales person go - maybe he was too honest.
