Seen advertisement for BMW online Sunday

Called Dave Walters BMW on Sunday 12-11-12. I think I spoke to Michelle. Michelle told me what she knew about
the car and said she could send pictures. She called back and said she could not send them but would have her
sales manager Sab call me in the morning.

Shab Tadayon called Monday at around 10: am. He gave me information about the call for sale. He told me what features
it had and said it was very clean, great car and it wont last long. I told him I was coming from Painesville and did not want to come unless the car was in great shape. I asked him if it had a full BMW inspection. He said yes and it was
very well maintained. He said it would not be on the lot if it was not. I told him I would come and see it at 2:30. At 2:25 he called me and asked if I was still coming. I said I was almost there. When I arrived Shab greeted me and took me straight to the vehicle. It looked like it was in great shape. I asked him about the vehicle. He again said it was serviced regularly, nothing was wrong with it and was in tip top working condition. I asked him about the process of putting a trade in up
for sale and he said it goes through some 100 point testing and inspection and a computer readout tells you everything that is wrong with the vehicle. Then they fix the issues before a sale. He added that they put new tires on, rotors, breaks, and maybe a couple other things in to it after trade in. He offered me a test drive. I said I was not from the area so he offered a route for me. It was a short drive about 10 minutes. I drove the car and it was driving fine.

When I returned we started the purchase agreement. He handed me of to the finance manager (Joshua DeLuco) who was also a sales person. The sales person showed me documents of the carfax and purchase agreement.
He then offered up a 15 minute discussion on how well maintained and great the car was. He said he personally knew the people who traded it in. While this was going on I signed the paperwork and made payment. I had a rental car at the
time that needed to be dropped off at a hertz dealer before I could take my car home. They had someone take me. It
was about a 40 minute round trip. I drove the rental and he drove my new car. On the way back the service engine
light came on. The young man drove it carefully back. Shab was there when we returned. When he learned
about the service engine light he said it was prob nothing but he would bring it in the shop and have a diagnostic done on the vehicle. He said it most likely a gas cap because they filled the tank for me. Not to worry. I waited about hr and he said I am all ready to go. He said it was nothing gas cap. He said Everything checked out well. So I drove home.

On the way home I noticed that when I gave it to much gas the rpms would raise but the car did not feel like it was increasing speed accordingly. I kept driving. The service light came on again. I made it home and noticed the red brake light came on and the 4by4 light on the dash as well. I tried to reset the lights thinking it was nothing again.By the morning I suspected that something may be wrong. I drove the vehicle to Classic BMW in Mentor and told them what had happened and asked for an inspection at 7:00am. They called me a couple hrs later and told me what was wrong with the car. The list of repairs to clear the faults listed in the vehicle would cost close to $2,000. They said the engine was starving for fuel and a cylinder was misfiring among other issues. He then told me that if it was not fixed the car would cease up and I would be stranded. He said the vehicle was not maintained well and that the things the mechanic (seasoned 30yr BMW mechanic) noticed indicated a lack of maintenance.in there opinion it was not up to BMW standards and it should have not even be on the lot in that condition. They also said that the faults were not cleared out of the computer so who ever diagnosed it would have seen the read outs. There was no indication of any gas cap issue. I canceled the check to Dave Walters. BMW and then called Sab. I told him what I found out about the car. I asked him to refund the amount I would have to pay to fix the car. He said he would call me back. Shab said to bring the car back and they would fix it. I called RJ and he said give them the opportunity to make things right. I picked up the car from classic and drove to Akron.

On the way there the call ceased up and stopped running 5 times. I coasted into Dave Walters. I parked by the
front doors and walked in. I asked for the general Manager. I told them about my recent experience driving there
and said the car was not even safe to drive. They said they would fix it and give me a rental. They said they would fix everything that was wrong with it. I gave them the paper from Classic. The GM walked me to the service manager
and asked him to give me special attention. He gave Joshua Jancha the list from classic, but told him not to give it to the mechanics but to do their own diagnostic. They went to pull the car in the shop. They could not move it. It would not drive at all. I decided to leave for work with my rental. Thursday.

On Friday morning I got a call from the GM. He said my car was ready and he would personally like to talk to me when I come. I went there at 3:45. He was walking me to the service area and stopped at a new car and said the reason he wanted to personally talk to me was SABATOSH. MAYBE YOU! I was shocked to hear these works out of his mouth and listened for more information. He said the the reason my car froze up on me was because I may have taken a couple of pieces off the engine. I said look I dont even know what the parts do. I didnt look under the hood and I am a Chef that was ridiculous. Then he said maybe the classic dealership sabatosh my car and they made up all those repairs just to scam me. He said nonetheless he had the car repaired and it is running great. He had 3 people drive it and there were no problems left. I asked him if all the faults were clear he said yes. I gave him another check and left. It only took me about 15 minutes to notice that the car was not repaired. The rpms were racing and engine not moving. I called the gm. He was not available. I called Sab. He was not available. Some one from Dave Walters placed a prayer card in the drivers door panel. Not sure why. Maybe indicating that he was sorry and was praying for me? I drove straight to classic and schedule the repairs for Tuesday morning 12-18-12.

I then called the service manager Joshua. I asked him to tell me exactly what was done to my car. He said a intake valve something and a thermostat. I then asked him if all other faults were fixed on the diagnostics. He said no it was running rich and a few other things. I told him he knows the car is not running right and he should stand up and say so. I said what they were doing was not right and he should speak up. He said little and said he would talk to the gm and get back to me. I told Classic what was done to the car and they said it didnt even need a thermostat. The assured me they will get the car running Tuesday and they dont know what is wrong with that dealer. I asked them if there was someone I could call but they said
not that they new of. Maybe an attorney. I called RJ a couple hrs later. Total expense at Classic to clear faults was $1772.59.
