Restaurant maeket equipment i will be there tommorrow as i promised

I am opening a small cafe.in late Sept Michael Osborne sold me some restaurant equipment and an installation package. This was contracted to be delivered Oct 5th. Today is Jan 3. Everday this guy says he will be there tommorow and promised the job will be done. He took my money in sept and cashed the check 2 days later. This man is a liar and he will det whats comeing to him in a leagel way
