I worked at the usfoodservice of va beach for a little over a yr. I resigned about a month ago. Five hours after I resigned, I received a call from Nancy Wilson, head of HR, informing me that she had received my resignation on her voice mail from that morning, and that she was terminating me.
When I asked her how she could terminate someone who had resigned, she became irate and repeated herself that I was terminated, and that was what would go in my file. I then informed her that I did have witnesses that heard me resign, and falsifying employee documents was illegal. That was when she began shrieking over and over that I was terminated. She sounded insane, and her voice kept getting higher and higher. I finally had to end the call.
The next day I put in a complaint with their check in line, which is where the employee complaints are supposed to go. They created a report, which was resolved in their favor. The only information they could give me was that Nancy Wilson had terminated me. There was no mention made of the falsifying of documents or her unprofessional behavior. I can only assume this is just how they do business.
I never received my last paycheck, and called and left Nancy a voice mail, inquiring as to why. She never called me back. I then called the check-in line, the corporate office and the labor board. This is still unresolved, and I may have to sue them. I have no idea if they believe they have a reason for hanging on to my check, as no one will call me back. I owed them no money when I resigned.
If anyone has any suggestions that may help, I would appreciate it. I've spoken to a couple attorneys who say that what they are doing is illegal, but I would need a lot of money to fight them.
