Homeside class action suit — CA and everywhere UNPROFESSIONAL & UNBELIEVABLE

Homeside has done fraudulent things again and again and again to me and I can't imagine it's just me. The continually "forget" that I HAVE insurance and keep ordering some for me from the outside.

Last year I paid in two payments one month — by the due date and on time — and instead of figuring it out or waiting until the due date to see if I'd pay the other half (I was trying out electronic payments), they started sending me back check after check.

I tried to call and was repeatedly told that they were too busy (after going through a phone menu gauntlet), call back later.

Once I got through and the guy said "well, to tell you the truth, I'm sitting her in total darkness and my computer doesn't work, so I can't look up your account".

I was told that Homeside "doesn't accept partial payment". Well, first, my Trust deed says that IS okay, and second, BY THE DUE DATE it was paid in full.

Washington Mutual received the same partial payment and, like Homeside, stuck it in an account rather than crediting me.

However, as soon as I contacted both lenders, Washingont Mutual simply took the other half, credited it, and there was no further problem.

I sit with Experian reporting two months of payments late over 30 days when Homesides own records show that's just NOT TRUE.

My repeated letters pleading my case seem to keep ending up on the desk of "E. Lopez" who either doesn't have the mental capacity or the authority to take a look at my account and see that I was NEVER late paying and assist me in correcting my false credit report.

What I don't understand is why Experian can't change my records since I send them evidence that I DID pay. Little Ms. Lopez just keeps sending me the same letter (she doesn't even change the date) saying that Homeside has to treat all its customers the same, which makes me wonder how many OTHER people are sitting with false credit reports that Homeside refuses to change.

Their technique appears to be to delay and simply not respond.

Well, if you can't reach anyone or get a response, they don't have to do anything, do they?

Now I'm having to deal with my father's account which used to be with Homeside also. His house was sold spring of 2001. I paid January's payment but let escrow pay whatever the rest would be.

Escrow also paid for January as is clear in the escrow papers. When I wrote to request a refund for January's double payment, Homeside's first ploy was to ask for Power of Attorney verification, even though I had ALWAYS conducted all business in relation to the loan (my father's in a nursing home).

So I sent that. Now they (S. Ferg) are saying that there was a late payment (February, which was paid through escrow) and DON'T EVEN MENTION the double payment in January which was the subject of my letter.

Now I guess I have no alternative than to send the exact same documents AGAIN, showing the double payment.

I've wondered if they purposefully hire stupid people to respond to customers or if they train them to act stupid so Homeside won't have to respond appropriately or give back the money they charge that is not warranted.

Yes, there's more... One one occasion I sent 92.47 (rounding off the payment) as an overpay, which I usually do and instead of crediting it as an extra payment, they credited it as a late charge!!!

On another, I refused some sort of mortgage insurance and they charged me anyway and my buddy E. Lopez couldn't seem to ever respond about that one either.

While it was $12.95 or something, I had clearly declined it! On another occasion they had charged me 19.20 for some insurance thing (which had been paid, but in fairness to Homeside, State Farm had not reported it properly), but Homeside had it on as an unpaid charge for MONTHS.

There are just SO many foul ups with this company and they are SO unprofessional it is unbelievable. Now I JUST read that Washington Mutual (which whom I have had a long and satisfying relationship) is buying Homeside, which might help all these people get help in correcting Homeside's MANY mistakes, but I have wondered how much Homeside is pulling an Enron on Washington Mutual.

Do they really know what they're buying? Either a fraudulent or grossly mismanaged company that is probably in big trouble because of all the mistakes and downright WRONG things they've been doing with the very worst of business practices.

I have a house on the market right now JUST to get OUT of Homeside's grasp. They call me trying to sell me things and the poor sucker who's supposed to sell me something gets to hear how I will NEVER do business with Homeside in any form ever again.

Well poor Washington Mutual, buying a company that will now have all their bad work downloaded on to WaMu. Poor WaMu.

I was once told many years ago "never do business in Texas" due to scanty laws and rules related to business. That advice echoes in my head today, both in relation to Homeside and Experian and now everyone will get to know all the details about Enron. It really smacks of blatant immorality.
