I have been having been having problems with Vanderbilt Mortgage since August. My husband had to remove his ex wifes name off of our home loan. We thought this would be a simple task but they refused to do it unless we gave them $7,500. We could not come up with that kind of money so my husbands ex wife to us to court where the judge ruled we take her off or put the house up for sale.

We ended up having to pay court costs plus her attorney fees of 2000.00. We had just had a baby and my father in law didn't want us to end up homeless so he lent us the money. We sent a cashiers check to vanderbilt for $7,500 dollars. They told us that it would be applied to our principal balance. My husband signed paperwork cause he was in a hurry without anybody explaining it to him.

They told him our payments were going to be 638.00. Our loan assumption amount at that time was 65,000. Then in august they raised our payments to $1,145.00. I started looking at the paperwork my husband had signed in november and realized that there was over $4,000 dollars missing from the 7500 we sent them. I have been arguing with them for the past 8 months and they still have not told me where the money is.

They told me it was applied to service fees.By law they need to provide a breakdown of the service fees. I have requested this about 20 times and they refuse to send it to me. Everytime I call I get transferred from one person to another. They tell me that they r researching it but they never call back. When my husband assumed the loan they told us that we owed 65,000 dollars yet after we paid the 7,500 our balance went up from 65,000 to 72,000 which I still can't get anybody to explain to me what is going on and where this money has gone to.

This company has caused me so much stress. They have been so rude they have made me cry several times. I have problems sleeping a lot of the times cause I'm stressing about what to do about this company. I have looked for an attorney but we can't afford a 5000 dollar retainer fee. Due to them doubling our payments we got behind for November, Dec and Jan which caused that to ruin my husbands credit.

We had to sell one of our cars just to get extra money to catch up on the payments. We took a huge loss on the car. Even though we caught up and were not even 30 days past due on Februarys payment they still threatened to foreclose. I called in and gave them Februarys payment to stop the foreclosure and I gave them a $2,400 dollar payment to pay a negative escrow amount which was also on our account.

I was assured the money would be applied to the negative escrow and that our payments would decrease to what we used to pay before they raised our payments. I got a confirmation and reference number along with the person who took the payments name and extension number and when I called to make my march payment I was told the money was misapplied. They promised they would fix it. They refused to take my march payment cause they said it was already paid.

4 days later I started receiving harrasing phone calls from vanderbilt telling me that we were two months behind again! I spent a total of 5 hours in one day on the phone trying to get this resolved. They never called back so I called them back and they told me the money was moved back to pay off the negative escrow and that everything was taken care of. Then they called me on Friday to tell me that my payment was 500 dollars.

I asked them why it was so little and they had to research it AGAIN! An hour later called me back and told me that once again I was behind 2 months. I complained to a supervisor who said they would call back and never did call back. Today I called once again and once again they misapplied the money. I am so frustrated I literally broke into tears. Since I have been dealling with this company my doctors have had to put me on blood pressure medication.

I spend so much time arguing with them on the phone that I have had to have my mom come watch my 2 year old so that I can sit and argue with vanderbilt on the phone. I have been getting headaches and stomach aches from the stress and I don't know how much longer I can deal with this. I feel as if I'm going to have a nervous breakdown. And the people who work there are all so rude. Please tell me if there is a class action lawsuit against them and how I can get in on it. I don't know what to do any longer.
