Refuses to refund monies for services not used

"Dear Client Care,

I talked to Jake Johnson several months ago regarding my not being able to use your accounting software initially because of not understanding the rpoduct and later because of medical conditions and my wanting to cancel this agreement. He advised I should contact [email protected]. I sent repeated emails with no response. I called several times with no response and finally got to speak with a person who told me someone would get back to me and I have not heard a word back.

In the last year I have had a heart incident which required insertion of pacemaker/defibrillator. A gall bladder operation which required several days of hospitalization. I was recently diagnosed with congestive heart failure and am now under the care for that. I do not have the energy to continue and must nap during the day. I am way behind in my lessons and progression with EBAY and producing a website with Internet Income Solutions, and as a result have not made a dime with this venture.

The $39.95 added to our credit card is more than we can handle.

I cannot continue with this and would appreciate positive consideration from your company and a refund of our monies as I have not used your product or services.

Hopefully someone will get back to me on this."

They replied as follows:

"Our firm canceled your account in December, therefore your monthly billing for the account has been stopped. As far as a refund for the services provided in your tax membership, unfortunately, we are unable to honor your request at this time. You had unlimited access to our tax advisers, as well as one filing of your personal and business for the calendar year of 2009.

Our cancellation policy for a refund is 3 business days from the date of initial setup as noted in the engagement letter you signed digitally on the 21st of August.

My email back to Eddie Fernandez dated March 9:

Eddie,

"I did not and was not able to access your tax advisors and I will not process my 2009 personal and business income tax returns with your company. I was not able to continue as outlined in my email dated March 2.

So what your saying is you are taking my money for no services rendered. I would say that you have a pretty good rip-off going.

I would entertain getting money for doing nothing, however I would not feel that was the correct and moral thing to do.

I guess I will have to do what I have to do."

I did not use their tax advisers nor do I intend on using their tax filing service and therefore feel I should be entitled to at least a portion of my money paid.
