Ripoff breach of contract, misappropriation of payments, hasty foreclosure The left hand doesn't know what the left hand is doing

Total nightmare and problems ever since they bought out our originial mortgage company.

We paid our homeowner's insurance 8 months in advance. They NEVER paid our insurance company after several bills, letters & faxes sent to them.

They then placed forced coverage insurance which was $1700.00 on our acct. I contacted them via phone & letter on several occasions with no response.

They either didn't know what I was talking about, or didn't care. Then after several attempts, finally had any attorney send them a letter regarding the forced coverage insurance.

They were in breach of contract, they finally credited our account but pro-rated the amount. Once again they were contacted because it was their error and negligence that my insurance was not paid.

Finally a year and a half later, they credited our escrow acct for the full amount of forced coverage. However, we were unable to file a claim on our homeowner's insurance due to their negligence on something that was covered. So we lost over $850.00 worth of equipment that would have been covered.

Then due to the 9/11 tragedy, I lost my job. We were caught up on payments except for just ONE. They kept sending letters stating that they would work with us so we would not lose our home.

This did not happen, they turned us down on foreclosure assistance. I did not qualify.

They then kept calling and sending harassing letters stating we were 5 payments behind. This was not true, we were only 1 payment behind.

We had all the documentation proving we were not 5 payments behind. We hired an attorney to assist us with this but have not heard from him at this time.

Now due to their negligence and misappropriation of payments, we are facing foreclosure.

I do not want to lose our home, I have worked too hard to get it and don't want to lose it.

We did everything they requested, and tried working with them in every way possible but no one will help us. Now they have sent us notice that our home will go to public auction on 9/10/03.

They didn't have an accurate accounting of our payments, breach of contract on our homeowner's insurance and now facing foreclosure. We are not the first they have done this too. They have been a real nightmare since day one.

Mortgage companies should not be able to screw people like this. It was their negligence and bad customer service that got us in this situation. No one wants to help.

The left hand doesn't know what the left hand is doing. I hope they can be held accountable for all the people's lives they are screwing with.
