Fidelity Debt Solutions
They broke contract agreement, and promised me a FULL refund which I have still not received

In November of I joined Fidelity Debt Solutions after viewing their ad online, where they offer 100% satisfaction guarantee, using CNN & FOX logos, (as though recommended), to provide debt relief for people in financial struggles. I was so relieved by the idea of having only one payment coming out for cc debt, versus 4 different payments to 4 different creditors demanding 36.99% interest rate on top of the minimum monthly payment of up to $500.00 $39.00 over the limit fee (if I couldnt afford the prior month), the $39.00 late fee. I was no longer paying towards the balance; my minimum monthly payments covered just the fees, alone! Joining FDS seemed like the smartest move at the time.
I submitted 3 credit card debt accounts into their program, and have made monthly payments regularly, that add to the sum of $4,021.13. Per my contract with FDS, I was to simply pay a set amount every month to a savings account, affordable to my financial situation, & FDS in turn would then negotiate with the agencies that I owe money to, and give them one lump sum, which would be a fraction of the total amount that these accounts had accumulated to, up to 60% less than the original debt owed! The money that I put into this savings account would go to the agencies whom are now representing the credit card companies, and then once a settlement was negotiated, (and granted I agreed to the amount), my debts would be paid off within the 36 months allowed.
Since joining this program, all 3 accounts have landed in the Law Offices of Marvin S. Dang. 2 out of the 3 are in summons state, with 1 on its way. According to FDS, it is very rare that an account will go into summons, and never, have they had a situation where all accounts will go into summons. I have had 4 different representatives from FDS in 1 year. Since my first account went into summons back in October of this year, I have been on the phone regularly with Crystal (my current rep @ the time w / FDS), asking her what I should do, and how they can help me. Crystal said just to write a letter of hardship to the judge, and wait for a trial date, which will give FDS more time to negotiate. Per FDS's instruction, I was told not to speak directly to the Law Offices of Marvin S. Dang, who the accounts were turned over to.
When the second account went into summons, I was mortified, now demanding to know why exactly I am paying this company when they have done nothing on my behalf to settle these accounts. Crystal then told me that the account that I was last summonsed for, was up for negotiation a few months back, for less than half of what was owed, but my representative @ that time (she doesnt know who it was) never mentioned it to me, and took the liberty of answering no, for me. I was very angry when I heard this, as they are supposed to notify me of all negotiations, per our signed contract, so that I may accept or decline. Later in this same conversation, Crystal told me to send a fax to FDS canceling my contract, and to demand a full refund of all of my money. She was genuinely sorry for what had happened, and assured me I would get my money back. I was surprised by her instructions. She was very apologetic and said she felt very bad that this was happening.
I followed her instructions, and on 12/01/09, I canceled with FDS. Crystal told me to call her the next morning to find out how her boss T.J. Was going to handle my refund. On 12/02/09, I called, as instructed, and Crystal said that T.J. Was going to try to settle my accounts for me with the Law Offices of Marvin S. Dang, and if he could not, he will in fact, provide me with a full refund.
On 12/03/09, I called and asked Crystal if any progress was made and wanted to know how they could settle my accounts now that I have canceled with them and revoked them having Power of Attorney. Crystal told me that once an amount was agreed upon, then they would request Power of Attorney again, so that the debts would be settled once and for all. She assured me that T.J. The big boss, was going to take care of this for me. I asked her how they could settle all 3 accounts when I only have $4,000 in my account. She told me they were prepared to use other monies to pay off my accounts. The following Monday 12/07/09, I had a medical procedure where a biopsy was taken, and was unable to reach Crystal, but did leave her a voice mail. I left her voice mails the following 4 days until finally Friday; she called back and said that Jennifer would now be handling this account. Jennifer offered to give me half of my money back, and I told her that Crystal said T.J. Promised to give me all of my money back if they could not settle my accounts. She said she was unaware, and she would contact T.J. And call me back. Monday, 12/14/09, I called Jennifer and left 3 messages, as she never did call me back. Monday afternoon, she did call to inform me that T.J. Was on vacation and would not return until the following Monday.
I now owe thousands more than I did when I entered this program, as interest has accumulated on these accounts, because FDS told me to leave the accounts open and not to close them. I am in fear that, not only has my debt increased significantly, but that I may not be refunded in full, by the very company that was supposed to help me get out of this debt. I warned them that if I was not refunded in full by the end of the week as promised, I would file a complaint with the Attorney General, and Better Business Bureau, making sure that FDS is exposed for what they are; a disgusting scam operation, preying and profiting on the misfortunes of others.
Please help me get my money back, in full, as promised. I have all conversations documented, as well as my contract agreement, and summons papers. I do not have money to throw away like this, and now, the Law Offices of Marvin S. Dang will surely be demanding payments, in full for these accounts. Please help me.
