Contractors, and small business' watch out for these creeps!
A representative from Benjamin and Williams contacted me about collecting unpaid invoices that I had.

I was told their service were completely free, and that they would keep 25% of any amounts they collected. I gave them an invoice for $7000 to collect, after sending the dead beat a letter threatening to sue him. He replied that he was not going to pay, Duh!

Their next step was to sue, they said they would need $750 upfront and that this amount would be added to the invoice as the dead beat was responsible on the original contract to pay collection fees.

Benjamin and Williams stated that no other fees would be needed from my company.
I stupidly paid these ripoffs. A month went by then they stated they would need an additional $2500 binder to pay the attorney who had filed a law suit against the dead beat.

If I did not pay the $2500 they would file a motion to dismiss the claim. Of course this would require the forfeiting by my company of the $750.
Did I mention to you that I never met any one from this law firm that had filed a complaint in my name, this was without even asking my permission to file a lawsuit.

I don't know about how the court system works, but don't attorney's like to meet with their client's first?

In the end my lawyer looking over the case said the law suit was filed incorrectly, and Benjamin and Williams had promised to split any monies collected with the attorneys, which is a violation of State law.

In the end they gave me all of the $750 except the fees for filing the lawsuit with the court system.

In a nut shell this company lied to me on just about every occasion, on a conference call, one that they did not realize I was listening into, they lied about our arrangement, and when I spoke up they hung up the phone.

Let me give all contractors and other small business people some good advice.
If you need to collect money from a dead beat, either do it yourself or hire an attorney.

All collection agencies are the scum of the earth, they have no power to collect money. Some advice to anyone contacted by a collection agency DO NOT PAY THEM until you can confirm they have authorization to collect the dept.
These scums will take the money and you will still owe it to the creditor.
You must ask for a verification of the dept in writing, before you pay these scums.
