Completely unfair when I (cardholder) attempted to dispute a charge

In February I paid $250 to a company called Data Depot for a service they described on their website. When it was time to use their service, it was very different than they led customers to believe. (They said you could access their service at any time you want - when I went to use it I found out you need to email them the information - but customer service closes at 5pm.) this was unacceptable - when I need to use the service it was after 5pm - and couldn't use it after that time.

Since I never used the service I requested a refund. They refused, even though on their "Terms and Conditions" it said your contract begins when you use the service. I disputed the charge with Capital One. They temporarily credited my account and sent me paperwork to fill out. I filled it out in full. Then they sent me a letter that I was missing info, and they rebilled me for the charge. I called again. They said I needed a "letter from a comparable merchant, agreeing with me that the charge was unfounded" - or something similar to that. I said I never did my email blast - so it was impossible for me to get a letter from a similar merchant. I said I didn't know any similar merchants who would write me a letter!

We went back and forth - "we" meaning me and customer service reps in India - numerous times. They took the charge off, then put it back on three times. Thoroughout the months I filled out 4 forms. Anyone reading the forms could easily see that Data Depot was a fraudulent company not abiding by their terms - and that I was clearly right. Any judge would have definitely sided with me.

I doubt Capital One ever even read the forms I kept having to fill out. The kicker is I received yet another form to fill out on June 30th. I filled it out and faxed it back. On July 23rd I received a letter from them that I had run over the 60-day time restriction to file a complaint, they were rebilling me for the charge, and the case was closed.

Over the course of the 4 months I was disputing the charge, I spent hours on the phone with them, a couple hours filling out the forms - all to have them end up rebilling me for the $250 charge and saying there is a 60-day time limit from when I get my statement to dispute a charge.

It's totally bogus. They never intended to be fair about seeing who was right and who was wrong - they just refused to cover the obviously fraudulent charge.

I'm so disgusted with Capital One that I am canceling my card and never using them again.
