To Whom it may concern:
PLEASE Help!!! I am writing to you ABOUT trying to save my house. My mortgage company is HomeComings (referred to as HC hereforth) and is based out of Texas. I was able to afford my mortgage until my husband ended up on disability AND THEY DOUBLED MY INTEREST RATE. I am a hard working mom with 5 children, and I do not know what to do except inform you and ask for you assistance in clearing up this matter. I am not asking for a hand out. I JUST want a FAIR RATE AGAIN!!!

We started with a house payment of $769 approximately 10 years ago. Four years ago we NEEDED a new roof so we chose to refinance. Unfortunately, my husband became disabled before I could refinance into a fixed rate.in March we were awaiting a lump sum SSI payment, and did finally fall behind on the mortgage; and was informed that I had been put into foreclosure.

I contacted HC who informed me if I paid them $4500 they would put me in a loan modification and then lower my rate. Mind you if the ORIGINAL $4500 been applied as they said on the phone this issue/circumstance would not even exist; but after20sending them the requested amount, they informed me that the money I had paid them in GOOD FAITH toward the balance of loan was instead going to be applied to their lawyers fees to put us into foreclosure instead of honoring the verbal agreement as they had led me to believe on the phone.

The $4500 amount would have almost brought me totally current. They sent me the loan modification paper work with an interest rate of 13.9%. Feeling that this was too high, I contacted my local Community Action Group at 937-341-5000 and their Rep. Monica McGee called on my behalf (who began documenting this ordeal back in June), and a HC Representative informed her that they would redo the modification then send me new paper work with a more reasonable rate of 7%.

I continued to pay in good faith the $1550 for 4 monthes, which was required for the active GOOD FAITH AGREEMENT as I waited for the papers to come. I have called this company repeatedly and have had a hard time getting through. When I did get through, I was told "Oh, we will be sending it out." Or just sign the higher rate modification to get you out of foreclosure. Then they would send the lower modification paper work for me to sign, this made no sense to me.

It made Us feel like they were trying to trick us into signing the higher rate; and then were going to say, You signed, and I coul d not guarantee that Homecomings would send the lower rate modification because they have continuously changed the requirements we have to meet once we have met the requirements they had laid out. This went on for four months. Monica tried to get the paper work and she was told that the papers should be received in a week.

In frustration I tried the Home Owners Association and they were also told that the papers where being sent out. To no avail, I never received the papers with the lower modification rate.in December I did not know how much too pay and tried to get thru repeatedly. I was told that the person in charge of modification was on vacation and to call back.

In January I started calling weekly and was told repeatedly that it was their fault that I never received the documentation, and that they were liable. They stated that they were going to REDO the papers and would get them sent out. They also informed that I was put back into foreclosure since the modification was never signed. How can you sign something that you have NEVER received!!! Can you please explain this to me? They again stated that they were liable and they would stop the foreclosure.

I called weekly from January thru the end of March and was once AGAIN told that they would be getting the new modification out. When I called on March 28 I was finally told that my house was going to the sheriff's sale on April 4th. FOR THREE MONTHS THEY LIED AND SAID IT WAS COMING AND NOT TO WORRY!!! I never received any type of court papers!!!

A HOMECOMINGS Rep then said if I paid another $3500 they would redo the loan modification under your plan since I qualify. I paid the money and continued to be on the sheriff's sale site for another 3 weeks before they finally removed me. They sent me a new loan modification with an interest rate of 12.9%. I THOUGHT THAT President Obama's plan was there TO HELP!!!

I once again contacted my local Community action group and spoke to Michelle Cauldwell, a certified HUD counselor who once again called and they requested more paper work, which we faxed. They said they need pay stubs for my husband's SSI disability. I explained that I do not get pay stubs and faxed them a letter from SSI. The person I spoke to was rude and informed me that they do not call or send a letter if more information is needed and that it is my responsibility to see if they need more information to proceed with the loan modification. THEN HE HUNG UP ON ME!

Aren't they aware that SSI does not give check stubs for direct deposit accounts? Question, How am I supposed to know what they need if they do not inform me what additional in formation is needed. I re-faxed my ALL of my paperwork. I was supposed to make a house payment on 6/4 to initiate another GOOD FAITH AGREEMENT (although I already fulfilled the previous GOOD FAITH AGREEMENT of $6000 and NEVER received the loan modification) this agreement would be for three months in the amount totaling $3900 before they would send me a new modification under the OBAMA PLAN.

My HUD counselor informed me that I qualified for a home owner's assistant grant which would allow me to pay a percentage and the grant to equal the full payment. She spoke to an agent at Homecomings, who said that was fine. On 6/4 we sent the total payment owed between a grant check and a money order. Michelle was told that they would not accept the grant money when she called to inform HC that the payment was being sent overnight as previously agreed to in two parts.

The Rep proceeded to inform her that only our money order would be accepted and would only be considered as a partial payment and the Grant money would be refused. I DO NOT UNDERSTAND how grant money cannot be accepted. I was told that if the Community Action Group had sent CASH then it would have been accepted. That sounds dishonest. Michelle went and got the director of the HUD Center, who has been helping homeowners for over 19 years. He informed the rep from Homecomings that they cannot do cash as this is a20grant and he is responsible for showing were all grant money is spent. (Aren't mortgage companies accountable for training the representatives in how grant money should be received?)

The rep from Homecomings proceed to inform him oh well we will still not accept the Grant money and we will still sell the house and then hung up on him. Is a GOVERENT CHECK not good and CAN THEY REALLY REFUSE A PAYMENT? That 1 OF HC'S Reps had verbally agreed to with a Certified HUD counselor? I am told that since I only made a partial payment that my house will now go on the sheriff's auction block.

On Friday June 5th I received an automated message in the evening saying that I now was required to pay $10,000 to bring my loan current. I was to respond by 3:00 on Saturday June 6th. I tried to call while on break from work around 11 and did not get thru. I then received another auto message on Saturday June 6th to respond by Sunday June 7th at 3:00. They are closed on Sunday so I was not able to respond. Isn't that considered harassment?

I have documentation of the numerous times that the Community Action Group, Homeowners Assoc and I have tried to contact them. I have receipts of the payments made. I have numerous phone records that I can pull showing the attempts I have made to stay in contact with this company. I have been repeatedly LIED TO BY HOMECOMINGS. I am worried as this is sending my husband toward suicide due to his medical condition.

I hardly ever get sick and now I am experiencing PANIC attacks which are affecting my ability to work and my children well being. So you know if I had a reasonable rate I could afford my house. I am not sure where to go now and I am writing to President Obama and all of my state senators and congressional members for guidance. Please contact me at. Thanks for your time in this matter.
