I fell behind in our Beneficial personal loan payments, due to my job and heavy credit debt. Sometime I would work 80 hrs and some time less. I contacted Beneficial main office in Rochester and told them my situation and they said that would refiance my mortgage to get my interest rate down lower. Well that went on for 3 monthns and in the meantime the collection department from beneficial kept calling for payemnt.

Benefical also was charging interest on two separate loan. One loan was old and they gave me a new one and both were suppose to be combined but they never did so I am paying for two high rates on two different loans.in their disclosure you can only have one acct open with one interest rate at a time.

I then call the main office and they said they would contact the collections dept to let them know that they were trying to refiance me, and they never did. I then wrote a letter to the collections dept to make a payment agreement to pay a 100.00 until my fiancial situation got better and one of the collectors named Tanya Davis called me back and said if I agree to make a payment of $170.00 then I would be ok. I agreed and started submitting payment that was agreeded upon.

Two days letter I started receiving calls nd letters from a law firm Rubin and Rothman that represented Beneficial. I recently received a call from a Jackie Evans yesterday from Rubin and Rothman who was very nasty and her tone was very racist. He mentioned to me that it didn't matter about what payment agreement I made with benefical she was going to sue me no matter what and she told be I better not laught because there was nothing funny and she hung up.

I'm not one to play the race card, but she talked to me as if I was nothing. She aslo mentioned that she was going file a judgement against me to have my wages garnished which will so tragic for me.

I cannot afford them to garnish my pay check, I have 3 children other debt and making under $26,000 a year. I am still willing to make the $170.00 payment which is all I can afford so I am not sure what to do as of now. I am going to write the Better Business Bureau about my situation, before something major happens.
