Credit Card processor that rips you off by charging things that were marked out of the orginal contract

We signed a contract with Encore payment systems to process our credit cards through our self owned business. When we were agreeing to the contract, we said we would NOT pay an annual fee, as there are so many companies out there that process credit cards without charging one. The women (their rep) crossed out the annual fee charge and changed several of the other charges to suit our requests. A year went by and there was a 95.00 charge taken out of our checking account. When we called Encore, they stated that that was the annual charge. I found our carbon copy of our contract and told them that it is clearly marked out, you can tell it's the same sorta mark as the rest of the contract had on it. They stated they had the orginal with our signatures and it was NOT marked out on the orginal. I requested to speak to the women that was our rep and was told she had car trouble but would be in shortly and would return the call. She never did. We have found out since that she no longer works for the company and did not work for them the day they told me she would call me back. No one returned my call, so we cancelled our contract with them. Now... They took out 202.00 for the $195 cancellation fee and 7. Bank charge. I called them again today and spoke to Carlton Little ext 1576 who states he is a senior rep and he once again stated that his copy showed that the annual fee was not marked out and they could legally take the $195. Plus bank charge out of our account. I told him we MAILED (because their fax numbers would not work) him the copy of our carbon copy of the contract and it clearly shows that it was marked out and he said he would fax me a copy of his where it shows it isn't marked out. I told him I would be in touch with a lawyer on Monday to sue their Butts. He said fine. Do not do business with this company. They let you sign a contract to meet your terms. Then alter it some way to make them more money. AND they do not return phone calls. If there are any lawyers out there that can help us... Please let us know.
