I called Fairbanks again today. I called them on lots of things. (all the problems I've had with them) One lady turned me over to someone else. Then I told this lady about all the problems. I discovered that they did that second "appraisal" AFTER I had paid my October and November payments. My mortgage was current. She "put it in her computer that I wanted the charges reversed." Yeah right... I called her on that one too...

I FINALLY found my paperwork from my original Mortg. Company. Fairbanks has to abide by the paperwork from my original loan.

I paid late payment fees when they would post my payment as, lets say, the 8th of a month. My original contract states that I have a 15 day grace period. These payments were NOT late. She was going to look into that. I told her that them doing these appraisals were illegal. I found a website about that, and talked to an appraiser. They are messing with Federal Law now.

She didn't like to hear that. She was looking into it, then said she made the "note in her computer." I kept asking question after question... Finally she decided she wouldn't talk to me. This loan only has my husbands name on it. A few months ago, we sent them a letter stating we wanted to receive our monthly statements, plus that it was ok for them to talk to me about the loan. We KNOW they received this, as we did receive a response from them stating that we would start receiving our statements in September. (which we still haven't)

She had no record of sending us anything... Only that we made a request in the computer! Unreal. She gave me the fax number again and told me to have my husband write a letter (again!) stating that it was ok to talk to me about the loan. I told her that I wanted comfirmation that they received the fax. She said they would send it to me within 48 hours. I didn't believe that a bit! I told her I would call her in 48 hours to make sure that they received the fax. (gee. I didn't realize that it took that long for a fax to send!!??) I think that she just got tired of trying to answer all of my questions!

Doesn't bother me a bit. I will call them every day if I have to... More than once!

I found a statement in my original contract... It states:

Inspection. Lender may make or cause to be made reasonable entries upon and inspections of the Property, provided that Lender shall give Borrower notice prior to any such inspection specifying reasonable cause therefor related to Lender's interest in the Property.

What does this say to you? To me it states that they had to notify me that they were going to do any inspection on my house. I wasn't notified of anything. Not even AFTER they did both of them. (even though the lady told me that they left a card on the door... Which they didn't)

I was charged a late fee from the very beginning.

Check your contracts. Read them good. I've sent a few more emails and made a few phone calls today. I won't give up on this rip off company. They're a joke.

I was mad about this whole situation... But now I'm REALLY P-O'd after reading everyone's problems on here. They are screwing everyone around.

Sorry to keep posting. I realize that this isn't a message board. (maybe we need one? Lol)

I will let you know if anything I've tried so far works. Anything to help against these people.
