Forcing us into forclosure when we don't deserve it. Class Action Suit anyone?!?!?!

Countrywide has really gotten us into a bind. Not only did they raise our interest rate when they weren't supposed to, they didn't even tell us before or after the fact. We did not find out until we had a forclosure notice put on our door. That notice came last December and we have been trying to work something out with them ever since.

Dealing with them has been a nightmare. We can never speak to the same person twice so you have to go through everything with them each time. That happens after you sit on hold for anywhere from 15 to 45 minutes. Not only do you get different stories and solutions from each person you talk to, you only get part of the story as to what will happen next.

First you get switched back and forth between the Modifcation and Repayment departments. You never actually get to speak to one of the negotiators. They are never available and they do not have incoming phone lines. The assistant you speak with must email your request for a call to them and they have 5 business days to respond. (They only had 2 days to respond when we started this process). To top it off, they have no control over when they call you back. It will most likely be during the day when you are at work and they will usually not leave a message. They count this as a call back, by the way. It is the same with their colletion calls I have been told. That is why they most likely tell you that they have been contacting you regularly even though you know nothing about it.

We got through the modification process and were told that if we sent in $3000 in good faith, theywould have a loan modification to us within 5 business days. This took over 3 weeks to get. We had alot of questions about the numbers on the modification but there was no negotiating a point. We grudgingly signedheagreement, got it notorized and sent it back overnight in the envelope they providided. Three weeks later I called to see how our first payment was to be made and found out at that time the modification had been declined. How could they decline something they had offered to me?

To mke a long story a bit shorter, we have gotten an attorney who hasn't had much more luck with them then we have had. We did, however, get a copy of our payment history. There are alot of things wrong there based on our bank records. Even internally Countrywide is messing up. Payments are not recorded as payments, money is missing from payments with no explanation as to where it went or what it was used for, just t name a few.

We have informed our attorney to file suit against Countrywide if they do not come to terms with this situation immediately. We are basing our suit on fraud, breach of contract and many ethical and consumer rights violations.

Is there anyone out there who would like to join our suit and make this a class action suit. It only takes 3 or 4 of us to get togather and get the ball rolling. The first thing we are asking for is an injunction to stop any legal procedings such as forclosure until the case is settled.
