I have received over the past four years numerous letters from NCO stating that they were trying collect past due funds for MBNA and that if I did not contact them or pay them they would file a report with all three credit reporting agencies and ruin my credit. They have made numerous calls to my work, cell phone, home phone as well as sending me letters demanding payment for monies I do not owe.
I have sent them numerous certified letters asking for proof of debt per article 15USC 1692 advising them in a timely fashion in writing and via telephone that I was disputing the validity of their claim and all portions thereof per the FTC Fair reporting ACT. This company has never supplied any proof of debt as requested, and has continued to harrass me and file numerous fraudulent claims on my credit report which I have been unable to get Experian, Trans Union or Equistar to remove. It seems its easy for a company to file a report stating that you owe a debt and are late but almost impossible even when it's been disputed to get it removed from your credit report.
This has caused me great financial harm as well as emotional distress and embarrassment from all the harassing phone calls and letters. Ms Jones at this company has been rude, demanding and unreasonable and has refused to supply proof of debt, claiming it was my obligation to prove I did not owe MBNA. This company is breaking the law, they call before 8:00AM and After 8:00PM and on Sundays as well. They give information to work associates, leave messages on voice mail boxes - without knowing it is the correct person and refuse to follow the proceedures required by 15USC 1692 of the Fair credit reporting ACT.
