They debited money from my checking account when I did not apply for or receive a payday loan from this company. A representative from the company called both my cell phone and work phone number threatening, yelling and harassing me, accusing me of fraudulently ripping off THEIR company when they had provided a loan to me, which is a total lie!

After I recieved numerous harassing phone calls, including a day where they called me 10 times in a row and I wouldn't answer their calls, they send this harassing email:
Date: 8/10/07

Dear Debtor,
At this point I can only assume that you are intentionally refusing to resolve this matter voluntarily, meaning you intentionally deceived this company. This company loaned you money in GOOD FAITH and funds were electronically deposited into your ACTIVE checking account.

Once you defaulted on the terms of the agreement, we were forced to allow extension fees to accrue on your account. I have tried to work with you to get this matter resolved but you have consistently avoided repayment on this account. I've extended settlement offers, and payment arrangements but you've refused every attempt to acknowledge this debt on a voluntary basis. Unfortunately I can no longer secure any unpaid cases so they will be released from my possession for further review between today (8/8/07) through (8/10/07).

This action will lead to a significant jump in the amount you owe plus further collection action will proceed swiftly. This is NOT a threat or any intention to cause financial harm, but my job must be completed. If you truly want to resolve this matter in an appropriate manner, then contact me with your payment information today. I understand that bad things happen to good people, but avoiding the situation doesn't make is disappear. I am willing to re-establish an agreement and secure this account, but I must hear from you today and a payment must be made on this account very soon. Making a small payment ($200) to put a hold on your balance is better than making none at all.

If no response is received from you then I will assume that you are giving me the authority to make the final decision regarding this account. Again, if no payment information is received regarding your account you can guarantee that I will be forced to pursue you for the full balance owed plus any fees associated with your loan contract. This is an action that I do not feel comfortable doing so please work with me. Please contact me via telephone or email to resolve this account voluntarily and prevent further collection action

To Which I replied:
Your company never loaned me a dime. You took money out of my account fraudulently and you were busted, so my bank decided to refund me the money. When an unauthorized ACH debit is made to my account, the bank and the government considers it to be CHECK FRAUD. The police and feds were already involved in the investigation that found me to be correct in the matter, and that is why I was refunded the money.

Your company has some "big ba*s" to continue to pursue me in this fraudulent matter considering you are under investigation by the police and federal entities. Upon conducting my own research, I have found that I am not the first and only person you have pulled this stunt with. There are dozens of others that have filed complaints with the BBB and numerous consumer reporting websites.

I am not some idiot who is going to be intimidated into paying money to a company who I filed a fraud complaint against. If you continue to contact me I will have no other choice but to have a complaint filed against YOUR COMPANY for harassment.

If you're going to file a lawsuit by all means just do it and leave me the hell alone. You know you and "your company" don't have a leg to stand on. You know the consequences if you continue to harass me, and if you take another dime from my account I will immediately pursue legal action against you and your company for fraud and harassment. We are on to the fact that the debit was attempted and failed under one company name. Then you changed the company name that conducted the successful debit. Get a life and go make an honest living like the people you are ripping off a*ole.

Any advice on how to continue further? Does anyone have experience with this company where they continue to try to debit money from their checking account after the bank has done an investigation and refunded money?
