On 4-26-07 paid 3000.00 for a wall to be bult as of 07-17-07 work has not beeb done

On 4-26-07 I sign a contract with Everett Mcneel to replace a wall that was damage in my back yard. The total amount for the job was 3,500.00 with a payment of 3000.00 down. Everett contacted me in June 07 to tell me the work was going to be finshed I have not heard from him as of yet. I want my money back the work was to be completed by 4-31-07.
