I paid off my mortgage to ASC in November. I knew the title company had given them more money than they were entitled to because the interest had been calculated several weeks beyond the payoff date. When I called to inquire about my refund, I was given the telephone shuffle (i.E. Oh, that's handled in another dept.- let me transfer you, etc) When I did finally get someone live on the phone, I was told there was no overpayment. All the monies had gone to fees, etc. I pursued it further, but finally gave up after numerous unsuccessful attempts at reaching someone there with 1/2 a brain. Honestly, it isn't rocket science!
Here's the kicker - in today's mail I receive this anonymous, unsigned letter from ASC stating that there was an overpayment after all w / a check for a portion of what I believe I am owed. No details, no accounting. Just a form letter & a check. I know for a fact that lenders are required by law to refund any monies owed from escrow accounts within 60 business days from the payoff date. It has been six months! I am going to sue these bastards. I kept all of that correspondence with names, dates, who said what when, etc.
If there are any litigious souls out there who want to join the crusade, let's put these jokers out of business once & for all.
