As a sudden single mother when my husband was shipped off to Iraq I know I was going to have some rough times, but this is crazy. As happens from time to time, my husbands pay was not processed correctly one month and I need to do an Payday Loan. I received the loan and paid it back as soon as I got my check. Then ofcourse I had to do another loan to live until my next check or my husbands pay came in which ever came first.
Long story short, I ended up in a very large hole. Although the government admits the error they will only pay overdraft fees to my account, and this is a long process, it takes months for the government to work this out.
I contacted the leander and informed them of the situation and that I would pay it next month on the following date. As I was two weeks over due on the repayment, it seemed that my call was good enough.
Apparently not, the next week (today) I received a call from Mr. Clark from Legal Mediation Practice at work today. He called a total of seven times in a four hour period while I was in meetings all day. He called again and finally reached me.
He then threatened me with fraud charges for writing a bad check and said that he would contact my employer to begin garnishing my wages and I had one hour to come up with the full amount on a debit card. He then told me that I could save myself the embarrassment of my employers knowing this information by paying right away. He said that it would be a good idea because employers today will fire associates for defaulting loans because they can not be trusted. He suggested that I call all of my family members and ask to borrow the money.
After our conversation I wanted to research the company so that I could see what kind of company would talk to anyone like that. I was unable to find anything at first other than sites with many people that had been through the same thing with this company and it had great advice on there contact information and what I need to do next to protect myself from this awful treatment. I had and have every intention on paying this loan and have very good credit.
After reading all this information, I called them back to receive a address and website. They said that they do not have a website at this time and refused to give the address to me and said that I can now go through my original lender. I have found drafts of the Debt Validation request and Cease and Desist and I am sending it via certified mail first thing tomorrow to stop this awful treatment. Thanks to this website, I now know my rights and the tactics there are not allowed to use.
