In October I went to make my monthly mortgage payment to Ocwen FSB and when trying to do so I was told my loan was transfered to Bayview Loan Servicing and was given thier phone number to make my payment. I called Bayview and tried to make my payment and was told by a Ms. Piedra 800-959-8229 that she could not take my payment because I was in Bankruptcy and I informed them that I was not and I was just trying to make my payment so as not to be late. Bayview still refused my payment and told me they would have to research my loan and they would get back to me and that I would not be considered late because when a loan is transfered you have 60 days before a payment is due. Well November came and Bayview still refused my payment and I spoke to a Mr. Flick 800-457-7534 who claimed they were still researching my loan. Then December came and I again tried to make my payment and was told they could not except my payment. It was no more than ten days after that I received a letter of demand saying I was past due and started receving harassing calls from A Marvin Miller 800-457-5105 demanding all money due. I was on a forbarence plan with Ocwen and was paying $800.00 a month my transfer letter from Ocwen stated no terms or conditions of my loan will change and I should continue paying $800.00 a month to Bayview. Marvin Miller insisted that they do not do forebarence plan and I would have to get all monies owed brought current by January. January came and since I was not able to pay all past due money which was mostly from escrow advances $8000. Marvin Miller than offered a modification with $2000 dollars down payment and he would mail me the paper work. Well the only paper work I got was FORECLOSURE papers and the phone calls from Marvin Miller got nasty. I called the Attorney for Bayview ROSICKI&ROSICKI (585) 815-0288and was told not to worry the motion to foreclose would not be heard for several months and when there was a court date I would be notified. There was a court date in June and the Judge Adjorned the motion for a later date which allowed me time to list my home and hopefully sell it before that weasle Marvin Miller could steal my home from me. Marvin Miller made comments like I seen the pictures of your house we (Bayview) should make some good money off that. It was a sad day when I sold my home but a good day because I did not lose it to Bayview Loan Servicing. It came time to get the closing amount and my closing attorney received a last minute call with a balance of $88,512.41. That amount is total wrong my Principal bal. $63,514.21 escrow $9779.22 late fee $471.64. That only comes to $73,765.07. Bayview only paid Ocwen $71,317 for my loan when it was transferred only 8 months prior to me selling it. Why was I chared $88,512.41 they Bayview has all this different fees listed but they do not have an explination for what the fees are for. My Attorney paid my Loan in full but in protest. I was over charged and I want my money back with interest. I am disabled from a car accident I was a passenger in 2003 and the money I should have had from the sale of my home could be helped me today on the little SSI I receive.
