Refusing to admit they had commited a mistake on a balance transfer I did not authorize

In 2000 I had a balance on a MBNA card. I was sent a advertisment from Discover about a 3.9% balance transfer.
I made the transfer. That was in March.

In July I still had the balance and wanted to know when the prom would end. I called to find out. I NEVER asked to make a new balance transfer.

This agent from Discover asked me for sensitive info on
my MBNA card even my mothers maiden name. I thought it was to prove my identity. The discussion was average.

I told the agent I did not want to make a balance transfer. The agent from Discover said she could not do a balance transfer and I would need to contact MBNA. I wondered about the MBNA info i had given her and thought it was strange she wanted my mothers maiden name.

I then hung up. Then a 3 days later I called MBNA. The
MBNA agent told me there had beeen a balance transfer.
I started to get upset because the Discover agent said she could NOT do the transfer. The agent quickly said hold on you do not owes us we owe you.

I was puzzled by this. The I got my Discover bill and I
was real upset then. This Discover agent was attempting to theft of identity against me as I had given her all the info she needed to pretend to be me and get MBNA to send her the credit she put on my account.

So I called Discover the day I opened the bill. I was told they could not do anything. I said i would get it taken care of. When this happens remember if you do not authorize it they can not even begin to make you liable.

But of course we are talking about Discover and it pays to discover. Well I am now after 6 years getting ready to take them to United States District court for violating a number of U.S.C. Statues over this issue.

The skinny on this is they have a lot of explaining to do and seeing how they refused to correct a simple error for 6 years and they were reported to the State Attorney generals consumer fraud divison and STILL refused to admit they made a mistake well folks it does not look very good for Discover.

Oh and Mitchell N. Kay a lawyer from New York who got involved in this issue is also going to be brought over here to court. Yep he got sued 4 years ago a class action suit for doing the exact same thing he did to me used fraudulent notices and violated the FCRA and the FDCA thanks to who ever posted that case here at rip off. It don't look good for either party.

Let's all hope that the judge hearing this issue deals with these corrupt practices and punishes them to the full extent.
