In mid December we started refinancing procedures with Conseco Finace. On January 4 I had to place a call to OCwen Federal Bank to have them fax over to Conseco finance a verification of mortgage (vom) and a payoff quote. The lady I spoke with at Ocwen explained to me that there was a $10.00 fee for the verication of mortgage and a $30.00 fee for payoff quote. The $30.00 would be added to my payoff quote but the $10.00 fee for the vom I would have to do a quick pay over the phone and told ok I then gave her my checking account information and the check number 1719.

However on Janaury 10 when they issued my check to my bank the amount wasn't for $10.00 like I had authorized it was for $950.00 which I did not authorize which caused me to be charged $18.00 NSF charge. Ocwen then posted a $950.00 payment to my account with them that I did not authorize and then they faxed over Conseco the payoff quote of $75,981.72. On Janaury 16 Ocwen reissued this check to my bank again for an amount that I did not authorize which cost me another $18.00 NSF charge and also caused another check that I had written else where to also bounce. On January 20 we signed all of our closing documents with Conseco Finance and they paid off a few bills for us and then sent Ocwen the payoff check for the amount they quoted of $75,981.72.

On Janaury 29 Ocwen contacted Ocwen stating they were refusing to except the payoff check from Conseco because it was short because my check was non sufficeitn funds so which makes the payoff check short of what they need to payoff my account. When Conseco contacted me about this I immediately called OCwen to find out what the problem was at that time I was told that check number 1719 for $950.00 that I had issued was non sufficient. I then told Ocwen I did not authorize a check for $950.00 I authorized a check for $10.00 for a vom. Ocwen then told there had been a mistake that my last payment of $950.00 ws still in their computer system and when the representative posted my check number 1719 she did not change the amount to $10.00 which caused my check to go through for $950.00.

I told Ocwen that I never authorized that amount and now you are trying to charge me for a mistake that was your (OCwens) fault to begin with. Ocwen told me then that I needed to pay them $950.00 before they could except the payoff from COnseco. I told OCwen that I needed to contact Conseco to find out what to do about this because I am not the one that made the mistake. When I contacted Conseco I spoke with Joel Deluna and we then placed a conference call to Ocwen on Janauary 30. Again Ocwen stated that I needed to pay them $950.00 before payoff could be excepted, I told them that I should not be charged for a mistake that they made Ocwen told us they realize they made a mistake but they still needed the $950.00 before our account to be paid off. After the conversation I placed phone call to Federal Trades Commission and filed a complaint with them against Ocwen.

All during the month of February and until March 8 Joel Deluna with COnseco Finance and myself placed phone call after phone call to Ocwen trying to resolve this problem I recorded every conversation and filed complaints with several different agencies, Attorney Generals Office, Comptroller of the Currency, Thrift Suprevision of Consumer Affairs in San Francisco, Thrift suprevision in Washington DC, Banking Commission and an Attorney here in Wyoming. Conseco Finance and I fought with Ocwen almost a daily basis trying to resolve this problem during these phone calls we talked to several different phone reps in the collection department assistant managers of the phone center and to managers in the payoff department and then we even asked to speak with the Vice President but never did get to speak with him. Everyone we spoke with admitted they (Ocwen) had made a mistake regarding my check.

Needles to say Ocwen was still billing me for January, February and March payments when I had already refinanced with Conseco but they (Ocwen) were refusing payoff. So during this constent battle with Ocwen they were charging me interest and late fees etc.in February they were asking that I pay them $2,900.00 for Janaury and February payments and late fees etc. Before they would except the payoff from COnseco. I told Ocwen I do not owe your company these payments because I have already refinanced and this whole situation is your mistake to begin with. At one point Ocwen tried to tell us they would have to reissue a new payoff quote before they could except payoff. Conseco told Ocwen they could not do this that they needed to except the original payoff quote they quoted on January 6.

After 38 days of this constant battle Conseco and I received a conference call from a Bob Hall with OCwen. Bob offered to waive 1/2 of the interest on our account for the past few months which meant that we sould have to pay OCwen another $2,000.00 and the original payoff check from Conseco before they coud excpet the payoff. Conseco told Ocwen that this was unexceptable because I was being charged for a mistake that Ocwen had made form the very beginning. Mr. Hall from Ocwen admitted the this whole situation was their fault to begin with. Joel with Conseco then made an offer to OCwen that if they waived all the interest they would send them a check for 76,780.06 if they would except this as payoff. Mr. Hall at Ocwen agreed to excpet this but the funds had to be in their hands no later then March 15.

Unfortunatley that meant that we had to pay Ocwen an additional 800.00 on top of the original payoff quote they had given us all because of a mistake that their company (Ocwen) had made.in OCwens original payoff quote they charged me $3,287.00 for an early pay off penalty which I knew nothing about. This Company is the biggest ripoff I can ever imagine having to deal with DONT DEAl WITH THEM.
