Sample of a letter that we sent
This letter is an official complaint in reference to the above mentioned Mortgage Company. I purchased a ranch style home in 2003 for $140,712.80 because my fianc' (Julie Fritz) suffers from MS and we were living in a town house with steps. My original mortgage company was Decision One Mortgage at some point and time Homecomings became our mortgage company, there was not a refinance.

Over one year ago my fianc had to quit work due to her MS symptoms and the treatment regimen she was on (chemotherapy and a daily injection). At that same time my ex wife (whom lives in CA) hearing I purchased a home decided to quit her job and take me back to Court for an increase in Child Support. Through Riverside California Superior Court my child support was raised to 823.62 a month. The counted her income at only minimum wage. The Judge would not take into consideration that she quit a 70,0000.00 a year job to stay home because her fianc (now husband) earns well over 120,000.00 a year.

Our financial bind began. Some payments were missed but when 2 payments were sent they were returned. While Julie fought for her disability, I was fighting for a new Court date in CA. Since then Julie now is receiving her Social Security benefits and I had a new Court date which reduced my monthly child support amount. Which on August 18 that amount will be reduced again, due to one of my son's turning 18.

The problem began trying to deal with Homecomings during this financial difficulty. I signed a release of authorization paper so that Julie would be able to try to deal with this problem. The individual contacted were as follows: Ken Spindel - GMAC Enterprise Risk Officer, Mike Kozlak GMAC Residential Capital Group, Bruce Paradis GMAC President (all with the GMAC executive offices in MN), Rosemary Love Executive Correspondent, Rachel Roberts Homecomings Financial Account Manager, and Arthur Calhoun Homecomings Loss Mitigation Specialist. The first was contact with the executives was in early May. Rosemary Love contacted her for the executives and she contacted Rachel Roberts. Ms. Roberts sent a form to be filled out and it was faxed back to both the GMAC office in MN and the Homecomings Office in TX. I heard nothing from them but then received the announcement of the Sheriff's Sale on 8/22/05. Again Mr. Paradis, Mr. Kozlak, Mr. Spindle, and Ms. Love to try to work out a payment plan. Then we received same forms again to fill out from Mr. Calhoun, they were filled out and returned again via fax with wage documentation.

Mr. Calhoun, Ms. Love and Julie spoke back and forth many times and they both made it really seem we could come to an agreement. During this time I also received a letter that my interest rate was being raised from 7.99% to 10.99% (that letter was received on June 20th). Finally on August 19 three days before the Sheriff's sale Mr. Calhoun told Julie an agreement could not be worked out, she then requested an extension on the Sheriff's sale (to have a little time to refinance) and Mr. Calhoun stated they couldn't do that either. At that time he said if we come up with $13777.55 before the sale we could save our house or come up with the refinancing a payoff amount was requested at that time. Today 9-2-05 a pay off letter was received from Mr. Calhoun for $155,662.57. At the time we purchased the house we only paid $140,712.80.

Please investigate this manner. I would also appreciate if you could contact Homecomings Financial and stop the sale until this manner is fully investigated. If the sale was suspended we have another Mortgage Company that said they could finance the house but that finance amount was only thought to be about 141,000.00. We have to contact that company now that the pay off amount was received.

PS I just received another letter from Homecomings Attorneys the new pay off is now at over 156000.00. I will be once again writing to all authorities mentioned
