Years ago my ex husband let a car financed thru Seawest get repossessed. Now, five years later, CPS has bought the debt owed. The first time I spoke with Angela, she was nice, willing to set up payments, and said they would only hold me liable for half of the balance as I was divorsed. I told her I would speak with my new husband and get our finances worked out so as to make payments and I would call her back.
Just this week I received a message from her, and my husband called her back as I was working. She was extremely rude, and when he said as much she went off saying " I cant beleive you just said the F word, Oh my God" "So you just you wont pay it" and various other lies. My husband called her from work. He works in a professional office with other people. He would not have been using profane language. He asked me to please try calling and I got the same reactions. She wouldnt stop talking long enough for me ask any questions. She told me that now that she had my updated information she was simply going to take me to court over it. I asked if I could listen to a copy of any recordings (when you call it says may be recorded for blah blah blah) she ssaid no I am keeping those to play back in court to prove your husband was swearing.
We left a message for her supervisor, and when he called me I was given the same treatment, only he said that he heard me swearing at Angela as well. He said that being rude in not against the law, that they are not a customer service center but a hard core debt colllection agency. When I again stated that I was wanting to make payments, he told me that it was going to court, if I had really wanted to clear this up I would have done it years ago.
They will not provide any information whatsoever. Whenever I ask they tell me I have the original vehicle sale contract and to look at that. However I have none of this paperwork as my ex husband took all of it.in our divorce decree it states that he is liable for the whole amount of the loan. Come to find out that that wont hold up in court. All that does for me is allow me to go after him for any money I end up paying. Of course I have no knowledge of his whereabouts, only that he may be in florida...
If anyone has information of how I should go about handling this, please let me know. I am not certain if they will actually take me court for $3600 or even the full amount of $7200, but they certainly are not willing to let me make payments dispite what they initially told me.
There seems to be no dealing with these people as they wont stop talking and yelling long enough for you say anything. My feelings on the odd way they would through lies into the conversation is that they are taping it in order to alter what is said. Angela repeatedly said I cant beleive you said the f word and other such accusations. I really dont know what to do. Seawest is gone, so there is now way for me to get the loan information. Any help would be greatly appreciated...
