Deceit in the Worse Way

I, too, was misled when purchasing a timeshare from this company. The salesman left out several key points that we needed to know, and as a result, our very first and last visit was anything but pleasant.

At the time we purchase the time share, our particular unit was not built. As an incentive to purchase the unit, we were given certain "perks", as the salesman would indicate... I. E preferred time of the year, a unit on the lower level, and we got to pick our desired area of the new development, street address and all!

What the salesman failed to mention was the yearly increase of the maintenance fee (from $350 to now $450). When we inquired we were told that fee would continue to rise as long as new timeshares were being built in the development. He also failed to mention that we had to schedule our vacation time at least a year in advance to take advantage of the "preferred" time given to us. He also failed to mention that we were not guaranteed the unit that we had picked out in the desired location or lower level.in other words, the actual address that was given to us as to where we were going to stay was just on paper.

When our unit was built a year later, we called two months in advance to make reservation at the development, and were told that they were booked up. I asked to speak to a manager, and after explaining to her that we were not told that we had to book one year in advance, that this was our first time using the unit, she reluctantly said she would try to find us something and would call me back.

We were not called back in a timely manner.in fact, I had to call back and leave several messages. Finally someone call me back and said they had arranged a unit for us.

When we arrived around 12 midnight, the clerk could not find our reservation. After making several telephone calls, he was finally told to take us to a certain unit. That unit was on the top level, and since I had a disability in my legs and could not walk up the stairs, we refuse the unit. When making the reservation, and realizing that we would not be getting the unit we selected, I repeatedly emphasized that we would need a unit on the lower level, as I was disabled.

Keep in mind that it was 12 midnight when we arrived, so it was literally like the "blind leading the blind", as the clerk was an elderly man and did not have a clue as to what to do. Fortunately, common sense kicked in and he finally found us a unit after three other attempts (the units were already occupied and we literally walked in on a family, with our suitcases in tow, who were in bed.) The clerk actually relinquished a key to us and when we turned the key and opened the door family members were everywhere bunked out for the night.

The unit that we purchase was a two bedroom townehouse. The unit that was found for us was a duplex cottage w/attached apartment. We were happy to be getting the upgrade for all our troubles, however, short lived it was. We had planned to stay one week.

The next morning, we received a phone call from the office apologizing for the mix up, and because we were so inconvenience we were told that we could stay in the cottage the full week. Wonderful you would think! Two days later we get a phone call from the office saying that they were looking for a townhouse for us, as we would have to move or pay the additional fee for the upgrade. We asked about the apologetic call we got just two days before giving us the permission to stay where we were for the inconvenience that we were caused. The young lady indicated she had made a mistake, and would have to find us something else.

The lady I talked to two days was not the lady who called us with the bad news. She lied and said she was the same person. We went back and forth arguing that fact until I hung up on her. When she called back, we informed her that we were refusing to move, and would stay the rest of our visit where we were. From that point on we were harassed every day, until we just decided to leave.

The saying, "Your first impression is normally your last", wholes true for us in this case. That incident happened almost 4 years ago, and we have never returned nor do we plan to. Oh yes, we pay our maintenance fee and mortgage payments, unlike Kings Creek it is a commitment we want to follow through to the end. Hopefully, one day we will be able to get some of our money back. We have tried to sell our timeshare through TimesShare America, but that is another ripoff story.

I advised anyone who is reading this complaint to beware of purchasing timeshares. Make sure you get all the facts because unfortunately, it is almost impossible to get out of the contract or sell it. IF ever a class action suit is bought against this company, I will be one of the first to sign up. The laws governing timeshares should be more compassionate to the owners and less toward the company... I. E maintenance fees, why should a person be liable for maintenance fees when he does not use the unit especially for a situation like ours where we haven't use a unit for 4 years, yet, six months before the next year, the company is asking for the maintenance fee, and if we don't pay by February 1st of the next year, we are not guaranteed a good reservation or a reservation at all!

I would like to hear from others who might have had a similar experience.
