I have been assessed 2 times in the passed 6 years. Once for $299 and then last year $869... With no warning or reasonable explanation. Now i get a letter from them which i feel is blackmail. It reads, in part "to overcome a pending increase in your 2008 fees - as much as $200.00 over last years".. They want the owners to allow them to waive the standard reserve funding fee... But they dont send me a ballot to vote yes or no... Only thing they send is a power of attorney form to mail back... That is very scary. And worrisome to me... How many owners are just going to sign and return it just because they threaten to up our maint fee and then do what they want since they will have so many power of attorney forms signed... Cant something be done where they have to explain where all of this money is going. I wrote the board of directors for a list of expenses. Also a list of owners so that i can contact them... I didnt get anywhere... I want to file some type of law suit and make them show me the expenses... There are 1872 owners. U times that by $869...
We are talking close to 2 million dollars. What did they do with that money... Do u know of an attorney that can help... Oh yeah their reason for the pending increase in fees is rising cost in construction (the bldgs have been built for 15 yrs), taxes (we pay the taxes separate), insurance (we pay 73,000 for insurance... Even if it doubled that would only be $20 each), utilities (i live in fla and i know they havent gone up much), and other operational services (maybe they should get our approval before they spend our money on services). Our fee is $564 a year, to threaten to go up another $200 is almost 40%! That is just outrageous... I think they are greedy and see us as sitting ducks... No way out and no way to fight...
We need to join forces and fight this... They shouldnt be allowed to just mail us a bill and expect us to pay it in 30 days or threaten to send it to a collection agency, which is what they did to me... I called and ask for a payment schedule and they said no... I had 30 days to come up with $869... And i didnt even know what the money was for and had no warning the bill was forthcoming... That is just so wrong on so many levels... Please help!
