MADIGAN SUES SPRINGFIELD FIRM FOR DECEPTIVELY SELLING ADVERTISING TO SMALL BUSINESSES IN RESTAURANT MARKETING SCHEME
Springfield - Attorney General Lisa Madigan today filed a lawsuit inSangamon County Circuit Court alleging a Springfield mans two marketing firms deceptively solicited small businesses nationwide to purchase advertising space on local restaurant placemats when the placemats were either never actually produced or never used by the restaurants.
Small businesses are already struggling to overcome todays difficult economic conditions. The last thing business owners need is to be targeted for false advertising opportunities that clearly will never benefit their bottom lines, Madigan said.
Madigan filed the suit against Andrew Ross and two companies that he operates, Nationwide Marketing and Coast to Coast Advertising, both of which do business as Nationwide Advertising. Through both companies, Ross employed telemarketing sales agents to sell small business owners advertising space on placemats that allegedly would be displayed at restaurants in the businesses local communities. According to Madigans lawsuit, the telemarketers falsely represented to prospective customers that the defendants had contracts with restaurants to supply the placemats.in fact, most of the restaurants that the telemarketers mentioned in their sales pitches were unaware of the defendants or any such marketing agreement.
After placing charges on customers credit cards during the telemarketing call, the defendants later sent consumers written contracts indicating that the customers would be automatically billed each year unless the customers cancelled the contract and that the defendants were not responsible for whether restaurants actually use the placemats. Madigans lawsuit alleges that the defendants failed to notify customers of these terms in their initial sales call and later failed to give the small business customers refunds when requested.
Madigans office has received 82 consumer complaints from consumers in Adams, Champaign, Macon, McLean, Peoria, Randolph, Saline, Sangamon, and Vermillion counties, as well as from 15 from consumers outside of Illinois.
Madigans lawsuit alleges that the defendants violated the Illinois Consumer Fraud and Deceptive Business Practices Act and the Uniform Deceptive Trade Practices Act. The lawsuit asks the court to prohibit the defendants from offering for sale and selling advertising opportunities in violation of state consumer protection and trade practice laws. Madigans complaint also asks the court to order the defendants to pay restitution to consumers, a $50,000 civil penalty, an additional $50,000 penalty for each violation of state law commited with the intent to defraud and all costs associated with the investigation and prosecution of the case.
Assistant Attorney General Avonne M. Seals is handling the case for Madigans Concumer Fraud Bureau.

Hey Feldman, how are things goin buddy? Bet you thought youd heard the last of me after that nice anonymous report came out on this same site about me. This was right after you and I had the conversation where you told me that I was the only one who was having a problem with you and then I told you that you and your fine upstanding business were plastered all over ripoff report, and you told me that anybody can write anything about anybody on that site, and Im sure we could read some bad things about you on there too. That was when I replied that I had already put my name and my company name on the search line and it came up no match found. What a coincidence that just a few days later it says Im a child raper. Let me tell you how this all plays out now, Feldman. I already got talked out of heading to Springfield with a gun by my hockey cop buddies and a minister. They told me it was not worth going to prison over a couple hundred bucks and some crap on the internet - hey maybe you guys will be able to shed some light on that theory in the future - Plus, they pointed out that scum like yourself usually have phony addresses listed anyway, so I hired a private investigator and sure enough, the address listed for your business is a trailer house in a really run down part of Springfield. But heres the good news, Feldman. I came up with a great idea, and I have you to thank for this. If youd just have done the right thing to begin with, you and I would have been all done, long gone, but now, thanks to you, this is not over. Youre going to love this - Im going to have this private investigator find YOU. I dont care about Nationwide, I want YOU. I want your home address. And when I get it, Im coming back on this site and Im going to post it so that everybody youve cocked off to on the phone where you were so untouchable will have total access to you. Wow, think about that one, Johnny, all of a sudden EVERYBODY that youve scammed and then blown off on the phone knows where you live. Does your family and your neighbors know what you do for a living? They will. It might take a while, but you know what, Ive got all kinds of time to spend on this. Have a nice day, Johnny-
Anybody out there want to help to find Mr. Feldman? Please feel free to contact me for details-
