I signed Jason Pack to a roofing contract in November and provided him with a $1,500 deposit. Jason (his company is named "Ahead of the Pack Construction") was to perform a complete rip-off of the existing shingles, flashing, gutters, etc. And install a new roof including paper, 30 year dimensional shingles, flashing, gutters, etc. Jason and I agreed that the work would be completed by the end of December.

After failing to show up for a scheduled December start date, I contacted Jason and was told that he was running behind do to job changes and a broken hand. We ultimately decided to reschedule the work for April (the work was to commence April 6). I assisted Jason in drafting an addendum to the contract that called for him to complete all work by April 30 at full price. The addendum spelled out a specific payment plan based on the percentage of the job that was complete. The addendum also calls for him to reduce the price by 10% if the roof is not fully installed by the end of April but is installed by the end of May and for him to further reduce the price by 10% if it is completed by June 30th. If the job is not fully completed by June 30, Jason is to return all money received and cancel the contract.

Upon contacting Jason approximately a dozen times over the past couple of months to verify he was planning on started on the agreed upon April 6 start date (and originally receiving confirmation from him that he was planning on starting on that date), I am now being told by Jason that not only can he not work on the project in April, but he will not reduce the price by 10% as originally agreed. I told him that I was considering that a breach of contract and that I wanted my $1,500 deposit back so that I could get someone that would do the job correctly and timely. He refused to give me my deposit back and is refusing to give me any information on whether and when he plans on installing the roof.

At this point, my confidence in Mr. Pack is completely ruined. I would like my $1,500 deposit back and would like for Mr. Pack to cancel the contract so that I can hire a reliable contractor to perform the work.
