My Account with the company was foreclosed after sevral missed payments. I've already paid $1310.65 to the company for a timeshare. I contacted the company regarding my situation and made payment arrangements. Most of the time the company enter my account on days that I did not authorize. I specifically ask the company to take me off of scheduled payment arrangements and for me to pay once a month when I had funds.
I also attempted to file a claim with the company for reimburstment of funds or partial reimburstment. I company say's that it was not possible for me to
collect any money back due to a foreclosure. I also ask them if I could establish a new account with the funds the recied from me. I was told that the old money was a loss and I would have to open up a new account.
My goal is to sue and file a claim to recieve some of the funds back.
Do the foreclosure laws in California allow to collect some money back. If so under what code?
