Norma Jean Payne Freight Forwarder/Broker lied about transit times and extorted us for thousands of dollars

In december of 07' the sales rep for DIF companies inc. Walked in our door. They offered us a great rate to ship containers from China to our Door in Texas. So great we couldnt pass it up. They also wrote on the peice of paper with the rate quote that the transit time from the port in China to our door would be 20-22 days. Remember that this is in december, so the transit time is crucial so the goods arrive before Christmas. Well the container took 35 days to get to our door and arrived the last week in December. So not only did we miss the Christmas deadline, we also get to pay taxes on all that equipment sitting in our warehouse at the end of the year.in addition, the fact that the container shipment was about 14 days late caused us to loose an estimated 20,000 dollars in sales. That is the first way they beat us down and cost us thousands of dollars.

Second way this company Ripped us off is the following. We decided to give them the benifit of the doubt and try one more container shipment with them. This time i made them agree to the transit time in a contract.

So the container gets all the way to the rail yard in Texas just fine with no problems. Then we get a call from DIF companies saying that the products inside the container have shifted and the weight is now uneven from one side to the other side. They tell me that the container cannot be put on a truck and delivered to us becuase the weight shift might cause the the truck to fall over. I asked them if they could open the container and i could come see it. They told me i could not come see the container.

They told me that they would have to hire a third party to open the container, take all my goods out and put them back in so the weight would be distributed evenly. They told me this would cost me aprox. $2,500 dollars. I again asked if i could come see the container and I was told no.

So, what choice did i have but to say ok have them do the work on the container because i just need to get the product so i can ship to my customers. I also told them that they would have to take pictures of the work done before i would pay for it. No pictures were taken. The company doing the work, charging me thousands of dollars, said the batteries in their camera were dead so they couldnt take the pictures. I just laughed when i was told this. These people are real con artists. All i was ever given was a peice of paper, the invoice, with the costs for labor and equipment used.

The kicker is that i took pictures of the container when it got to me. All the goods were in perfect condition and looked like they were exactly the same as when they were loaded in China. I even sent the pictures i took of the container to the factory in China and they confirmed that the goods were in fact the exact same as when they had loaded them in China. Also, none of the plastic that was wrapped around the good had been scratched or torn off. The good hadnt shifted one bit and there was no evidence to suggest otherwise.

So I finally got this container delivered to me. But wait there is more, and this is the part that is highly illegal. What they did next can get you sent to jail.

We had one more container on the way that they were handling for us. It had already left China before they had extorted me for the above mentioned money so i had no choice but to deal with them. So as mentioned above i told them i would not pay for the work done on the second container without pictures of what was done. Well they didnt take any pictures, so i didnt pay them for it.

So the last container gets to the rail yard in Texas and they tell me i can have this container, when i pay for the charges on the previous container for the work that was done. This action is illegal. Extortion. The courts defined the word "conversion" as when a company holds the property of another person hostage for payment on a previous shipment or service they rendered. When they did this to us they essentially "converted" the ownership of the property to themselves without my authority.

So again to get the last container delivered i had to pay for this "work" that was done on the previous container. They ripped us off big time and cost us thousands of dollars in lost sales. Now they are coming after us for payment on the last container delivered. They dont even know what is coming to them if they take us to court.

This company employees young kids to do their dirty work. They send them out into the world to lie and steal on their behalf. This company will lie to you about transit times. They team up with other companies to extort you for money. They are con artists. DO NOT do business with this company unless you have 10's of thousands of dollars to throw away. You will loose this much money or more in the end. I hope at least one person reads this and can be helped.

If any law firms want to contact me, i would be more than willing to listen. Since the amount lost by us is over the small claims limit, we will need legal representation if this ever has to go to court.
