1. Cargo in transit for 62days and of those sitting in ports for 44days (2/22-4/24).
A. Customer misleading.initial ETA was given as 35 days, but in reality it was 62 (My broker said Zim does this all the time).
B. Lying about ETAs, when in reality Zim from the beginning had predetermined ETA based on their forwarder schedule (internal document) and all the dates that were given to me were made up. (Broker told me that too).
C. Five ETAs were provided within those 62 days none were delivered. (3/31; 4/5; 4/7; 4/10; 4/15; 4/21; and then 4/27 (It was delivered on 4/21, after I sent a complaint to commerce department and they got involved directly. They lied even to them.initially, they said it was going to be the weekend of 4/15 (have e-mail to prove), but I sent another e-mail on 4/20 when I found out that ETA 4/21 was changed to 4/27 (have supporting document for this incident). I have supporting documents for all of those ETAs promised never delivered).
2. Holding cargo hostage at destination of arrival, without any explanation, and without permission from my broker. (I have in possession an e-mail written by Zim employee dated on April 13th that says to not release cargo under any circumstances).
A. Zim denied placing any hold on cargo, initially telling me it was not them that placed hold on cargo and Zim USA had nothing to do with it.
B. When I told them that I was aware of Zim employee e-mail regarding placing hold on my cargo, then they refused to talk to me stating I was not their customer, nowhere in the bill of lading my name was mentioned and to discuss with my broker (Again I have supporting documents that they have talked to me and to my friend in the past providing details about my cargo (have e-mail to prove that) even though my friend and I were not their customers then either, as they claim to be. So by talking to me and my friend in the past when they were not supposed to they already were breaking rules and regulations).
C. Broker denied placing any hold on my cargo, stating it was Zim initiative.
3. Holding cargo indefinitely in ports that are cheap until they collect enough cargo for 2-3 vessels, and then they ship all cargo at once. Therefore cargo can be sitting in ports for 2-4 months. (My broker told me about it, and added Zim does that all the time and their customers complain about it constantly).
4. Not providing a bill of lading to its customers. They never print them (my broker told me that). I have a copy of e-mail from Zim that says bill of lading was not printed, and to release my cargo without printed bill of lading.
5. Destroying internal documents? Initially a person told me that she had a document in hand that stated clearly that my cargo was prepaid (she read to me off that document over the phone), I even have her e-mails addressing the issue, and then in a day she refused to talk to me, and her supervisor told me that they did not have any documents stating that my cargo was prepaid and that I had to pay additional $3,000 in addition to already paid $4,000. (which I did pay, as I did not want to argue). (I wonder if they can destroy internal documents?).
6. Demanding to retract my complaint I filed with FMC if I wanted the problem solved (this order came directly from a company president). Which I did as I wanted my cargo finally delivered. When I did retract my complaint the promise was not delivered, they continued holding my cargo anyway.
