False Advertizing & potential fruad

Auction.com advertized online and by mail an open house on January 23rd, of a studio at 330 e 33rd street, New York, New York. It was item 31 in their listings of properties to be auctioned January 29th. (unit 11-e). Prior to the open house and upon Auction.com suggestion (800.793.6107) I clicked on the agent for the property and gota 'Joseph Felic' at the above phone number. After at least five or six messages, none of which were returned, my phone number was electronically blocked. Auction.com couldnot even give me the unit number. As the posted open house was listed on January 23rd, from 1 to 4pm I physically showed up at the address at 2:09pm. I showed the male consierge the printed brouchure, which he did not read, and said bluntly, "there is no open house in this building today" and walked away, saying over his shoulder, " some lady was asking about an open house here earlier". At 1:17pm on the 24th I called Auction.com, all calls of which are suppose to be recorded, and spoke to 'Kristin' about what had happened. She assured me I would get a call within 24 hours as she would "run it by her supervisor" before the auction and it was my hope to see the place before that time. I obtained a cashier check for $2,500 so as to bid on the 29th of January at 811 7th ave, New York, New York. No response was forthcoming so I did not attend the auction without seeing what bidding on. Six weeks ago a condo on the west side of Manhattan which was advertized with Auction.com had a similiar occurance: It had the addresses listed and by clicking on the agents name a buyer could set up an appointedment to see the place. However, afternumerous attempts no one returned messages and I went by thebuilding only to have the female consiege have no knowledge of a unit for sale in the building. At least in this instance, attempting to call posted agents number did not get electronically blocked. Were either of these units ever really availiable? If not, why advertize them publically then make them totally unaccessiable, without even retuning messages or going to the trouble of blocking them? (It was a different real estate agency in this instance than Joseph Felic is with). Of course Auction.com will not give any specific information out after their auctions.

Let the buyer beware.
