Who does the animal shelters protect

I have been worried about this dog for a couple years. The owner keeps the dog on a runner, the dog is filthy, he does have a dog house with torn, filthy blanket, chain link fence around his area The dog is a short hair dog, he is outside in good weather and bad. It can be freezing, snowing, hailing thundering, etc and that dog is outside. I have talked to the owner to take the dog to my house and he said "no" The dog is fine. I have taken clean, dry blanket/food/treats to him. I have seen the dog freezing/wet, but I can't go there everyday. He was very skinny and with me going there, he was gaining weight. He gain so much weight "good weight" that I loosened his collar because it was so tight, the dog couldn't swallow. The owner tightened it back up later because he lost so much weight again, I couldn't get up there for awhile, the owner put a zip tie on it so I couldn't loosen it again. I went there to visit on May 24 and the dog started to eat dry leaves and had barely any water, I got some food, he ate about a half of a grocery bag full, some treats and I gave him a bucket of water, he was starving, he also has fresh scars on his face and is swollen. I have called the ASPCA in "Oroville, Butte County", CA twice and they won't do anything. What does it take for an animal shelter to protect an animal, and what are the laws? I told the shelter that I would take the dog, get it back to good health and find it a good home. It's a very sweet dog and it's a pit bull. I have a chihuahua and they have become friends. Does anyone have any suggestions?
