It was May 15 and my daughter was sitting on the end of the shopping cart on the underneath ledge, I was at the shelf choosen a food item, when I heard her screech I turned around to see her finger bleeding. She had rolled the shopping cart over her finger and ripped her fingernail down to the first knuckle. I went to the front immediately to take her to the bathroom to check the severity of this. Once I determined that she needed medical attention I proceeded to the register closest to the bathroom to let the cashier know I had to leave my cart becuase of my daughter's finger. She had seen me with my 10 month old and my four year old go into the bathroom and had already called for a manager and assistant to help take care of my daughter.

The Co-manager on duty that night was very kind and took the appropriate information and his assistant help bandage my daughter so the bleeding could be controlled. He asked if I was going to seek medical attention. I said yes he said ok and wrote down where I was sending her and told me that he was going to file a claim, which they have to do anyways, but said that someone would call me with a claim number and information on how to obtain coverage for the medical bills I was going to obtain.

This sounds like everything went well... Wrong!
No one called me the next day to see how she was doing. I had to call that Monday to speak to not the manager but a security personnel who explained the claim needed filed and someone would be calling me. I waited till the end of that week into the beginning of the next week. CAlled again and was told someone should have called you. I was told they would get a hold of CMI, claims management, and get someone to call. Another week went by and no one called again. I made an appearance and it was on the holiday weekend and was told by the security personnel not the manager, who I asked for, that she wouldn't be able to get anyone to call me until the end of the week after the holiday.

I then filed a complaint at the head office and received a phone call from Brian at Walmart stating that they can't control the time frame it takes for CMI to call people. He said I have to call and see what the hold up is. He gave me the number. They didn't even have any notes regarding my daughters status, which I gave to Walmart on a weekly basis, considering I had to call and try to see what the hold up was. The CMI took my name, number and address and said someone would be assigned and call me back.
I have been playing phone tag with Misty at CMI since then and I finally spoke to her today June 16 and I explained the situation. She stated that Walmart only has coverage for accidents when it is their fault not because of the negligence of the parents/guardians. Negligent! She told me I should have had my four year old in the shopping cart seat! What where my 10 month old was. She then told me I should have been watching her better. She explained when her kids were younger she watched them closely. ASked me if I expected a Walmart associate to walk with me to watch my child while I shop to ensure she doesn't have an accident. I then said it isn't like there are kid friendly shopping carts available and she then continued to tell me that Walmart didn't have to supply shopping carts. WHAT! I asked if you expect consumers to shop at Walmart what the hell are they supposed to use to carry their items in. No answer.

I told Misty that I didn't pursue getting information from Walmart because I thought they were at fault. She stated well then why are you calling. I stated because the co-manager stated Walmart would take care of it. She then stated what was his name. I couldn't recall but I explained to her his description and she already knew what store number 1804 so she would call and ask him if that is what he said. Then she would have to speak to her team lead because they don't pay for accidents because a child was doing something they shouldn't have been doing.

At this point I was disgusted! First I am told that I am not a responsible parent, I am 32 years old and have been a caregiver of not only my children but as an occupation for several years, but that Walmart doesn't have to supply shopping carts. Well I am glad we got that straightened out...
Not one person spoke to me with concern or compassion with my daughter's unfortunate event. The only person that was nice was the gal at head office who took my complaint down.
I have been going to that Walmart for 5 years and have been treated by their eye doctor for 5 years. I will NEVER, i mean NEVER set foot in that WAlmart again. I haven't even begun to start my complaints and enforce that something be done.
So parents beware don't bring your small children to a WAlmart and remember that if they run out of shopping carts well I guess they don't really have to supply you with them anyways!
