Actual fraud.
Fraudulent deceit.
Fraudulent concealment.
Fraudulent conveyance
Criminal mischief
Vandalism
Obstruction of justice
Uttering false documents
Conspiracy to defraud $30,677.00 usd
Imparting or conveying false information (title 18, usc)
Misprision of felony (title 18, usc) (1)
Provisions pertaining to private business transactions being protected under both private and criminal penalties (h.R. 3723)
MYERS VACUUM / DEAN MYERS cannot be TRUSTED to honour contracts or provide RELIABLE PRODUCTS.
We purchased a LAB-3 centrifugal molecular distillation system for $30,677.00 USD. Delivery was promised in 4 weeks.
Once DEAN MYERS had received the funds in full he began to stall, postpone and delay the delivery. Three times the trucking arrangements were made and had to be cancelled.
NINE WEEKS LATER the LAB-3 was finally ready for shipment. When we asked if the paper work was ready DEAN MYERS replies " isn't the trucking company going to have that"?
DEAN MYERS then had to be INSTRUCTED that he is required to produce an invoice and a CUSTOMS DECLARATION.
DEAN MYERS had stated that the LAB-3 would come in a crate that weighed 600 pounds. We paid the trucking company in advance $1600.00.
The LAB-3 did not arrive in a crate instead it arrived on a palet packed in assorted mismatched boxes with plastic wrap around it and no interior packing. It looked as though MYERS VACUUM had no experience with shipping large objects internationally.
THE TOTAL WEIGHT WAS ONLY 295 pounds. We lost $800.00 in excess shipping charges right off the bat due to DEAN MYERS IGNORANCE.
The instruction manual was out of date and therefore inaccurate. Drawings that were supposed to be included were not. When the drawings were requested they did not arrive for six weeks.
It took that long because ROGER KORMER jr had dispatched the drawings via over night courier WITHOUT A CUSTOMS DECLARATION and they were returned to him the next day.
Weeks later we had to request the drawings again because he had not sent them out again.
When we attempted to run the LAB-3 the temperature controller did not work. Then the heating element failed.
When the LAB-3 failed RIGHT OUT OF THE BOX DEAN MYERS was NOWHERE TO BE FOUND. When DEAN MYERS was asked whats wrong with the LAB-3 he states THAT IT SHOULD WORK and that he would ask ROGER KORMER jr if he has any ideas.
We then engaged an independant electrician on the weekend, at great expense, who verified that the LAB-3 had been improperly wired at two locations and as a result the rotor was fried. It was also stated that a qualified electrican would never had made those errors.
That was a friday. We did not get a response till MONDAY. It was as though DEAN MYERS did not give a s—t since he already had the money.
On monday DEAN MYERS states that they " don't have a clue " and to send it back for repair at our expense. We say that it is hardly fair that we should pay since the device was miss wired at his factory and as a result it is defective.
At DEAN MYERS leisure the " repaired LAB-3 " finally arrives back in our original box WITH NO PACKING AND NO INSURANCE
. Because our box was so sturdy it survived but it was not meant to be used for a return trip.
The first thing we notice is its not the same LAB-3 that we had sent for repair. We suspect that he had switched it with the other LAB-3 that he has for sale as used that had been returned by another customer.
The LAB-3 operated for two hours then the nylon belt broke. We had invested $2000.00 for a spare parts kit but IT DID NOT CONTAIN A SPARE BELT.
After more delays DEAN MYERS finally sends a steel belt. We replace the belt everything seems to be ok and when we turn on the rotor heater the FUSE BLOWS. We replace the fuse and it blows again.
Finally we reach the point enough is enough. We advise DEAN MYERS that we will be requiring a refund because the LAB-3 cannot be relied upon period. That it never has worked and that we had lost far too much time and money on our projects to date.
Well, all of a sudden DEAN MYERS says he will be here to fix it in 2 days. Like where the hell were you when it did not work out of the box THREE MONTHS AGO. Meanwhile the warranty was getting bled down day by day.
We state quite clearly that the LAB-3 CANNOT BE RELIED UPON and we will be requiring a refund.
Suddenly DEAN MYERS is upset because we won't give him a chance to fix the LAB-3 so that he can prove to us that the lab-3 really does work.
Six months had now gone by since we had given DEAN MYERS the funds. The LAB-3 had not worked out of the box, it had already been sent back for repairs and as a result we COULD NOT RELY ON THE LAB-3 as there must be a flaw with the rotor heater design as well as other unknown problems.
Suddenly its time for DEAN MYERS to cry a bucket of tears. How we won't give him a chance etc. Etc.
DEAN MYERS and ROGER KORMER jr then state in a transcribed telephone conversation " if we want to return the LAB-3 it would cost us a restocking fee of $21,000.00". We tell him NO DEAL and they state they will call back shortly. They do not call back.
We email them a generous offer of a 20% restocking fee of $6000.00 as well as paying the return shipping costs.
DEAN MYERS then demands a restocking fee of $10,000.00 and states that he doesn't have to take it back anyway.
Meanwhile we do some research on DEAN MYERS and find out that he is selling obsolete technology, a high maintainence museum piece.
Dean Myers had sold the LAB-3 as being " state of the art ', that the Lab-3 was in great demand and that he had an assembly line going and it was best to order sooner then later due to the demand for the LAB-3. Unfortunately we bought his BULL S—T and DEAN MYERS successfully hustled the monies out of our pockets.
We then send an email advising DEAN MYERS that we were on to him and he quickly accepts our generous offer of a 20% restocking fee, that " he doesn't want to do business with us anymore (thats exactly what what we have been trying to tell him) and to MAKE SURE THAT IT IS FULLY INSURED.
The LAB-3 is returned professionally packed. All tracking records as it travels indicate no damage. The LAB-3 is delivered received in good order on Monday Sept. 8th / 08.
The next day DEAN MYERS advises us that the LAB-3 had arrived and that " the other still components were badly damaged. Welds were broken off chamber, tubing bent, panel knobs broken, manafolding deformed, panel covers bent, dented and scratched ".
When DEAN MYERS advised us the next day he had already had the vandalized LAB-3 picked up to return to us DESTROYED.
DEAN MYERS then states its an insurance issue between us and Federal Express.
DEAN MYERS or one of his associates had wilfully destroyed the LAB-3 and as a result have defrauded us of $30,677.00.
The losses to date to our company as a result of DEAN MYERS criminal behavior is in excess of $250,000.00.
Further investigation has revealed that DEAN MYERS has been to court several times already for BREACH OF CONTRACT.
We are now left with a destroyed, incomplete, defective LAB-3. DEAN MYERS has also stolen the vacuum pump and the parts kit as they have not been returned.
Myers delivered a lab3 that was miss wired in two locations as verified by an independent electrician.
In fact Myers was selling a product that was designed 15 years ago. He just bought bits and pieces and then thought he could flog it to the public as the real deal. Myers is selling obsolete technology. A high maintenance museum piece. The writer realized that something was not right when Myers failed to acknowledge receipt of the final deposit and then began to stall, postpone and delay delivery. When the device failed out of the box MYERS WAS NOWHERE TO BE FOUND.
The public worldwide beware of having any dealings with these criminals.
Shortly these criminals will find themselves " in the brig ".
To all uss buchanan shipmates. Dino has used his connection to the uss buchanan as a reference in order to secure the sale of the defective lab3.
Forensic examination has now revealed that DINO MYERS and RODGER KORMER jr had originally supplied a USED lab3 AS NEW.
" It is an older unit that has spent most of its life in storage. Major differences is the vacuum manifolding is copper, vacuum valves are brass ".
We did not receive the new model. The manifolding was not copper and the vacuum valves were not brass.
DINO MYERS direct quote is " I have a older unit but does not have to many hours use it spent most of its life in storage. Major differences TO NEW is vacuum manifolding is copper, vacuum valves are brass ".
As stated we DID NOT RECEIVE the new model that we had paid for in full and in advance.
The manifolding was not copper nor were the vacuum valves brass.
There is no limit to dino myers criminal behavior!!!
RODGER KROMER JR did sign for on September 8/08 as received in good order three boxes.
That you, RODGER KROMER JR, did or instructed another party to cut the two boxes on the side panel at the bottom thru the industrial grade duct tape in a straight line with the same tool that was used to open the top of the boxes in order to make it appear as though the boxes split on the sides in transit.
That you, RODGER KROMER JR, then began to vandalize the writers property to the tune of $30,677.00. That you did twist the manifolding and bend the bottom plates that hold the glass vessels on the distillation unit. That you took a hammer to the control box and that you unscrewed the front and rear panels of the pumping module and unscrewed the bottom cross braces resulting in the complete destruction of said unit.
That you, RODGER KROMER JR, then filed a false claim for damages in which you did not state what the damages were nor did you describe the packing material. That you did not fill out the required information because you felt that you had already gotten yourself in too deep already and that you did not want to implicate yourself further.
That you, RODGER KROMER JR, failed to advise the writer IMMEDIATELY about the purported damages which is what any NORMAL PERSON WOULD DO under the circumstance upon receiving the returned lab3 totally destroyed. Why have you not produced photos to attest to the state of the arrival of the lab3 LIKE A NORMAL PERSON WOULD DO in order to protect yourselves from a counterclaim. Why would you sign for the destroyed lab3 in the first place? These are questions that you will be required to answer to the police.
You only advised the writer the next day after you had made arrangements for the pickup of the lab3 " as damaged " in order to have the evidence of the crime removed as quickly as possible out of the State of Pennsylvania. THAT IS A CRIMINAL OFFENSE.
You had also claimed a call tag for the third box fully intending to advise the writer several days later that the third box was also damaged. You did not have the third box picked up when you realized that your fraud was falling apart.
You then attempted to pay the refund due on the third box without even waiting to find out if indeed your claim stood the test LIKE ANY NORMAL PERSON WOULD DO.
You then attempted to defraud the writer for a part that was returned and signed off on.
The completed forensic examination states quite clearly that all damages were done by hand. There was not one scratch on the casing on the distillation unit or the pumping module. The glassware was in perfect condition. Would you care to explain that? Damages are in different directions. Screws do not unscrew themselves.
The boxes were taped up only once after opening. The taping is clearly in place to hold together the slashes you made on the bottom side panels as well as to seal the top for return. YOU HAVE LEFT BEHIND COMPLETE FINGERPRINTS ON THE STICKY TAPE.
You then returned the lab3 minus the packing in order to cause further damage to the lab3 on the return trip so that it would appear that it was improperly packed to begin with.
MYERS VACUUM had promised to pay a refund upon the return of the lab3.
Myers Vacuum was denied the funds from the bank to refund to the writer for the return of the defective lab3 and as a result, in desperation, DINO MYERS AND RODGER KROMER JR. Did CONSPIRE TO DEFRAUD the writer of $30,677.00 USD by vandalizing the lab3 and uttering a false document in the form of a fraudulent claim for damages against Federal Express.
The police will be coming TO SEE YOU MR KROMER. You will have to account to the police how you received the lab3 in good order and signed for it and then sent it back the next day " as crushed " with the slashes on the side panels taped up on a box that was in perfect shape the day before.
You will also have to account for how the panels unscrewed themselves and the fact that the damages are in all sorts of different and inconsistent of directions.
You will also have to explain how the glassware is in perfect shape. Why was the one gallon oil jug not smashed?
Mr kromer you have a lot of explaining to do.
Has it been made quite clear to you Mr Kromer that you are IN VERY SERIOUS TROUBLE WITH THE POLICE. Make no mistake about it. You will be brought to justice!
