How can these rip-off artists be allowed to continue?

I never received a bill from Prevention Magazine, nor did I ever receive a copy of the magazine; however, now I've been sent an Account Status: Delinquent Notice demanding payment. What I cannot fathom is how these companies can fraudulently "make up" these bills and send them to forthright individuals. If this becomes a "hiccup" on my credit report, I will definitely SUE them!!!
